| With the rapid economic development in China,financial consumers are increasing tremendously.At the same time,due to the rapid growth in financial industry with breakthrough innovations,financial consumers are dazzled by a wide range of investment products.Since the financial market is more and more complicated,the contradictions between consumers and products,as well as the conflicts between consumers and institutions,are growing in breadth and in depth.The rights and interests of financial consumers are severely violated in financial disputes,thus how to protect consumer’s rights and interests has been paid more and more attention to in society.Among many financial rights and interests of consumers,the security rights are the most basic one,which is directly related to the fundamental interests of consumers.Furthermore,it is also the basis and prerequisite for other legitimate rights and interests of financial consumers,thus it should receive considerable attention.However,China’s existing laws and regulations are not adequate to protect consumer’s security rights due to the increasing complexity of the financial sector.Moreover,many financial problems remain unsolved,such as the lack of legal definition for "financial consumer" and the lack of systematic requirements for the protection of consumer’s security rights.Focusing on consumer’s security rights in finance and investment,this paper explores how to improve the current laws and regulations in this regard.This article is divided into the following chapters.Chapter 1 is introduction.It explains the background and significance of this research,based on which the current academic research on the protection of consumer’s security rights at home and abroad are discussed,and the methods and ideas of this article are outlined.Chapter 2 talks about the security rights of financial consumers in finance and investment.This section firstly describes the concept of finance and investment and its evolutional process in various modalities.It aims to establish sufficient background for further exploring the protection of financial consumers’ security rights.This section also provides further information on the domestic and foreign definitions of financial consumers,based on which this article summarizes the scope and definition of financial consumers in investment banking.Chapter 3 states the theoretical basis and basic principles for the protection of financial consumer’s security rights in finance and investment.This section firstly explores the theoretical basis from three different perspectives,including economics,finance,and jurisprudence.Thereafter,it further proposes three basic principles.The purpose of this section is to provide sufficient theoretical basis and legislative principles to further demonstrate the protection of consumer’s security rights in finance and investment in the subsequent sections.Chapter 4 is the main content of investment and financial management with respect to the security rights of financial consumers.This section focuses on the security rights that financial consumers should have in the increasingly complex financial sector.This section is one of the key sections of the article,and it sets forth the main content of financial consumer’s security rights by analyzing the current infringements in the financial sector in China.Chapter 5 illustrates the existing problems regarding the protection of consumer’s security rights by analyzing its current situation in China from three perspectives,including legislation,supervision,and remedy.Chapter 6 discusses about the lessons for the protection of consumer’s security rights learned from other areas outside mainland China.This section focuses on the financial reforms in UK,US,and Taiwan in terms of the protection of consumer’s security rights,and summarizes their successful experiences.Chapter 7 provides a proposal for the protection of consumer’s security rights.Based on its existing problems in China,this section draws on the successful experience of UK,US,and Taiwan to improve China’s current laws and regulations in this regard from three aspects,including legislation,supervision,and remedy.It aims to provide reasonable suggestions for the protection of consumer’s security rights in China’s financial reform. |
