Research On The Filing Of Network Fraud Crime

The convenience and openness of cyberspace has brought people instrumental and public value,at the same time,its virtuality and concealment also has brought a series of Internet crime including internet fraud.Internet fraud is the emerging technology of new problems in the development of network society,is also a new task faced by the law.At present,At present,there are many reasons for the high incidence of cyber-fraud in China,the difficult of Internet fraud case filing is one of them.So,What is the relationship between internet fraud and related crimes? What is filing status quo of China's network fraud? What are the reasons that make the network fraud filing difficult?What is the way to solve? All those are worth exploring in this thesis.The first chapter is introduction,which puts forward the research purpose and significance of this thesis.The second,third chapter is the theoretical basis.The second chapter analyzes the relationship between network fraud and related charges.The third chapter briefly introduces the concept,characteristics and functions of online fraud.The fourth chapter mainly introduces the current situation of online fraud registration from the source,acceptance,review and processing of the registration materials,and provides a realistic reference for the analysis and summary of the reasons for the difficult registration of online fraud.The fifth,sixth chapter is the core of this article.The fifth chapter points out the causes of network fraud filing difficult.Including high condition of the current criminal case,lack of the fact of network fraud filing conditions;judicial practice of filing procedure fause;network fraud filing materials review period lack of scientific standards and other reasons.According to the problem raised in chapter 5,The sixth chapter aims at getting the solution path.Distinguish the network crime and the traditional crime filed standard,reduce the starting condition of the crime of network crime,and promote the smooth filing of the network fraud;to determine the network status in the criminal law on fraud charges to meet the conditions of the fact network fraud filing requirements;the establishment of preliminary investigation system to solvethe network fraud filing procedures for the virtual home;the difference between economic crime and traditional crime involving the filing review deadline guarantee network fraud case in a timely manner to solve path.The purpose of this thesis is that from the perspective of network fraud,to reveal the current situation of the network fraud cases,analyze the reasons for the difficulty of network fraud and put forward the solution.Article research value lies in: to the criminal prosecution related laws,regulations,judicial interpretations,administrative rules as the main line,It is pointed out that the conditions,procedures and contents of the filing should adapt to the relevant requirements of the Internet fraud crime,and reveal the important role of the filing link in the fight against and prevention of network fraud.
