Niche Of The Judicial Function After The Socialist Legal System Coming Into Being

The socialist legal system with Chinese characteristics has come into being, and the construction of socialist democracy and the rule of law in our country has entered a new stage. In such context, it is significant both in history and in times to promote the scientific development of the people’s court. Of course, we should deeply analyze and re-construct the relevant elements of the judicial function, and accurately grasp the scientific orientation of the judicial function.Based on the investigation, this article analyses the ideal and the reality of the judicial function, probe into and realize the regression of judicial function. Also, this article describes and evaluates the current situation of behavior of the judicial function according to the selection of five aspects with target significance. Further, it clarifies the restrictive factors affecting the behavior of current judicial function. Such, this article puts forward the select way of the people’s court to give full play to the judicial function.
