Sports broadcasting rights,an important right in the sports field,has been payed close attention to by the national sports broadcasters.China sports industry has ushered a new stage of development in recent years.Sports events grows vigorously.The acquisition of international well-known events of new media copyrights,Tencent sports,Letv sports,and Wanda sports have also changed the old broadcast situation in which CCTV dominated sporting events broadcasting.The younger generation's spectator-watching habits show that traditional television broadcasts are becoming obsolete,while as the Internet is booming that viewers watching sports events via mobile app,mobile client,IPTV,etc.are increasingly becoming the main force.And the ever-changing sporting event market presents a new challenge for the sporting events broadcast protection.In the Internet Ecosystem,we can not only watch the sport events live show,carousel,or rebroadcast through new media,but also can watch the video highlights events on demand,along with the reform and development of Internet technology.But the new torts are also occurred.Live sports signal can be acquired through IT technology,and be broadcasted without authorization,which brought huge economic loss to the relevant sport events rights owners.There are still many problems and loopholes in the sports broadcast protection in our country.In order to better adapt to the new internet environment,protect the broadcasting rights of sports events,and promote the sound development of China's sports industry,this thesis is mainly research the sports broadcasting right by using the method of literature,expert interviews,comparative study to review and analyses the problems of the protection of sports broadcasting right development in China.It delves into the relevant legal concept of sports broadcasting rights in China,broadcast rights protection content and mode,and the existing sports torts to propose solutions and better protection.The study found that the rights and responsibilities of the legal rights of broadcasting rights of sports events are not clear.There is no clear definition and protection of laws and regulations for sports broadcast rights,although some related legal cases can be part of protected and handled according to Copyright Law and Anti-unfair competition Law terms,but there are still many loopholes.With the development of Internet technology and the rebroadcasting of sports events in more media platforms,more infringement problems came up,such as live broadcast and rebroadcast infringement,news report infringement,and infringement beyond the scope of the commercial agreement,etc..Because the sports event plays on many media platforms and the sports event broadcast has timeliness,therefore the infringement treatment on protection and the compensation for the sports event broadcast rights owners are quite limited.We should establish and perfect the relevant legal system,standardize broadcasting sports events market,improve the internet protection technology,strengthen the advertising of sports broadcasting,and establish sports arbitration institutions in China,for ensuring the fair and reasonable sports broadcast,and standardizing the sports broadcast market,to better promote the development of sports industry.
