An Investigation Into The Protection Of The Broadcasting Rights In China Basketball Association(CBA)

Since CBA was founded in 1995,its economic value and social value have continued to rise.In addition to being a well-known sports event,CBA’s inherent commercial value and sports cultural value have also injected key forces into the development of my country’s sports industry and social and cultural development.Among them,CBA broadcast has played a role that cannot be ignored in the development and progress of the entire CBA industry.At the same time,it should be noted that my country has not yet formed a reasonable protection system for the broadcasting rights of sports events.On the one hand,the economic and social benefits brought about by CBA broadcasting are constantly reminding us that we need to strengthen its regulation and protection.On the other hand,the current legislative and judicial protection of the right to broadcast sports events is not optimistic.Therefore,it is of great practical significance to explore the development and protection of CBA broadcasting and to propose feasible strategies for the protection of CBA broadcasting rights.This article takes the CBA broadcast right as the research object,adopts the literature method,expert interview method,case analysis method and logic analysis method to deeply analyze the current situation of CBA broadcast,find out the problems and loopholes in the CBA broadcast,discuss the reasons for the formation,and In order to protect the CBA rebroadcasting rights and improve the legal protection system of CBA rebroadcasting rights,corresponding countermeasures and suggestions are put forward.This paper mainly draws the following conclusions:1.The status quo of my country’s CBA broadcasting is gradually showing the characteristics of diversification.The broadcasting income is constantly rising.The CBA broadcasting income has gradually become an important part of the CBA income and even the income of Chinese sports events.The broadcasting expenditure situation shows a positive development trend as a whole.CBA broadcasting Rights need to be protected in a reasonable and standardized manner.2.The broadcasting rights of CBA are seriously infringed during the broadcasting,and the relevant legal protection is not perfect.The broadcasting companies tend to be monopolistic.At the same time,CBA itself lacks competitiveness.rights and interests.3.The "sports event power" should be created in the sports law and supplemented by means of property rights protection.Judicial guidance cases should be introduced and the judicial trial system for sports event broadcast rights should be improved.This strengthens the protection of CBA broadcast rights.
