Research On Several Problems Of China University Internal Rules And Regulations System Construction

The construction of modern university system in China started late.The Ministry of Education officially started the work of formulating the universities statutes since 2012,as now almost all the universities statutes have been approved and entered the implementation phase.Forming the university internal rules and regulations system which takes the university statute as guide is the next focus of the construction of the university system,but the theoretical research is still lagging behind which about how the university statute play the leading role in the university internal rules and regulations system and how to systematize the university internal rules and regulations system.This research is based on the theory of the system and the related knowledge of pedagogy and law.Firstly,it defines the relevant concepts of the university internal rules and regulations system through the literature research method.Secondly,through comparative analysis,it can conclude that the external system of university has common characteristics in the formulation of normative documents,and the university statute plays a leading role in the university internal rules and regulations system with its fundamental purpose.On this basis,according to the theory of system science,this study finds the position of the university statute and the university internal normative documents in the university system,which clear the system function of them,further put forward the leading role mechanism of the university statute playing in the internal system of University.It is necessary for university statute to show the integrity of university internal rules and regulations system.And it is also necessary to achieve the unification of "Commonness","personality","purpose" and "means" through the provision of the basic principles of university internal management so as to play the leading role of university statute.In addition,"perfect","normative" and "unified" are the value orientations in the process of systemization of university internal rules and regulations system.On the basis of defining the connotation of "perfect","normative" and "unified" in rule of law,and on the basis of the reality in the context of "take the university statute as the leading role",it proposes three specific principles,the principle of completeness,the principle of cooperation and the principle of enforceability,which should be follow during the university internal system forming process.Thirdly,in order to further understand the current situation of the construction of the universities internal rules and regulations system in our country,as well as it's urgent to study the system of student management,this study takes the university student management system as an example,through the analysis of the text of statutes of the 38 "985-project" universities and the internal normative documents of one "985-project" university which are about student management,concludes that there are still some deficiencies in the system at present,such as perfection,normalization and unity,and the leading principle of university statute in the system still needs to be strengthened.The newly revised "Student Management Regulations of General Colleges and Universities" promulgated,means that the current university student management system adjustment faced with two tasks,one is to amend the relevant content of the student's rights and student management system,the second is to take this opportunity to solve the problems in university internal rules and regulations system drawing on the previous analysis.This study argues that there is a gap between the theoretic state and the actual state of the construction of the university internal rules and regulations system.There are three reasons for the lack of normalization and unity of the current university internal rules and regulations system.The first is the reality of the construction of the university internal rules and regulations to take the problem as the guide and the long absence of the university statute.The second is a lack of standards for the establishment of university internal normative documents.The third is that the construction of the university internal rules and regulations system has "Inertial thinking" and "the rule of man thinking".In order to construct a perfect,normative and unified system,this paper puts forward three suggestions.Firstly,the construction of the university internal rules and regulations system requires the systematic thinking,the rule of law and the idea of the University.Secondly,continue to strengthen the university internal rules and regulations system top-level design.Thirdly,pay attention to the integrity,normalization and unity of the university internal normative documents.
