On the basis of acknowledging the patentability of business method, exploring the development motivation of financial patent from the theory of endogenous growth, constraint induced and transaction costs, and make a basic classification for the bank's as aggressive strategy and defensive patent strategy. Furthermore, Cross-database retrievalling financial patent of commercial banks between China and US, exploring their general and technical features.General features are:The patent review methods of the two countries show a pine tight state; patent application has experienced twists and turns up together; the applicant's concentration is large different; the applicant countries are also different. Then select citi bank and ICBC as typical case to study their patent distribution and strategy. It is concluded that ICBC financial patent applications are mainly focus on hardware equipment, less involved in online banking payment, mobile payment and data security, with relatively low-tech, implement defensive patent strategy of localization; on the other hand, citi bank tend to apply for patent all over the world, mainly relate to core technology invention patent such as electronic cash system, knowledge management system, certification system, authentication methods, and analysis model of transaction data, implement aggressive patent strategy of globalization, The latter is the high ground of financial competition strategic in the future.
