Research On The Legal Effectiveness Of Agricultural Non-point Source Pollution Prevention And Control In China

In 2010,the national pollution census report shows that agricultural sources of pollution gradually replace point source pollution,a major contributor to environmental pollution.However,for a long time,China's environmental protection focused on industrial pollution and urban environmental pollution prevention and management,ignoring the agricultural and rural environmental pollution prevention and control.At the same time,in order to ensure the limited land area of cultivated land,the effective supply of agricultural products,pesticides,fertilizers,plastic film once as a means of increasing crop yield in the nationwide wide promotion."High yield,high consumption" of the agricultural production model gradually replaced the traditional farming model,the excessive use of agricultural inputs and livestock and poultry manure,residue and other agricultural waste caused by unreasonable disposal of agricultural non-point source pollution has become increasingly prominent.At present,in order to comprehensively promote China's ecological construction,increase environmental protection efforts to achieve green sustainable development of agriculture,agricultural non-point source pollution prevention and control of imminent.The actual operation of the law as an important means of testing whether the law on paper is effective is an important part of legal control and should be given sufficient attention.Therefore,on the basis of field investigation,this paper takes the practice of agricultural non-point source pollution law of individual counties(cities and districts)in Yunnan as the research object,and synthetically uses the method of law sociology and legal anthropology to study the local law.The introduction introduces the research background and significance of the article,domestic and foreign research status,research methods,the main research content and difficulties.The article is divided into five parts.The first part is an overview of agricultural non-point source pollution in China,and introduces the characteristics and damage of agricultural non-point source pollution and the current situation of agricultural non-point source pollution in China.The second part is the legal system of agricultural pollution prevention and control in our country.It introduces the constitution and environmental laws,administrative regulations,departmental rules and normative documents,and the local laws,regulations and other normative documents of Yunnan Province are closely related to agricultural non-point source pollution Related legal system.The third part is the empirical investigation and analysis of the legal effect of agricultural non-point source pollution prevention and control in China.The author uses the questionnaire survey and the form of individual in-depth interviews,the use of the survey results,from the agricultural non-point source pollution knowledge and prevention of legal awareness of the law,the prevention and control of the law,affecting farmers agricultural production behavior and agricultural non-point source pollution prevention and control laws The law enforcement situation and other five aspects of empirical analysis.The fourth part is the analysis of the causes of the legal effect of agricultural non-point source pollution prevention and control,and explores agricultural non-point source pollution from six aspects:farmer's cultural level,production and life structure,legal consciousness,law-abiding ability,law enforcement situation of agricultural sector and legal provisions The reasons for the implementation of the law?The fifth part puts forward some suggestions on how to improve the legal effect of agricultural non-point source pollution prevention and control,including improving the comprehensive quality of farmers,increasing legal propaganda,perfecting the law,strengthening the law enforcement and implementing the five aspects of cleaner production?...
