On The Improvement Of The Community Correction System In China

Community correction system is developed by some western countries in the 20th century to the penal system of reflection and reform, it conforms to the social development and progress of human civilization to become the development trend of the execution and trend around the world. Although community correction in our country started relatively late, but it conforms to our country scientific and democratic ruling idea, it is developing and growing up rapidly under the superiority of the socialist system. Community correction system in our country from the pilot beginning in 2003, expanding the pilot, gradually improving comprehensive pilot has been through twelve years. It has established lots of practice experience and system basis. Amendment to the criminal law of the People's Republic of China,2011 (8), formally established the legal status of the community correction system in China. In 2012 Two "houses" jointly issued by the "measures for the implementation of community correction, effectively regulate the work in the system of our country's community correction system and procedures. In 2014, the fourth plenary session of the eighteenth on comprehensively advancing the rule of law certain major issue decision asked" to improve the implementation of the penalty system, unify the penalty execution system "and "establishing community correction law". Community correction work in our country has rich experience and remarkable achievements, but there are still some problems to be resolved urgently.In this paper, the text is divided into four parts. The first part is the introduction of the article, this part mainly introduces the research background of perfect community correction system in China, the perspective of the significance and research method and the concept of community correction in order to make clear the research direction of this article. The second part analyzes the practice of community correction system evolution and results at China and abroad and putting Ningxia as an example.It provides practice basis to perfect the system of community correction in our country. The third part, on the one hand, analyzes the legal system of community correction existing in legislative model and status of the existence of community correction system, lacking of clear rules, implementation and enforcement subject unclear, the object scope fuzzy, program content unclear in liability and the related legal system imperfection six problems. On the other hand, it analyzes the related existing organization system, it points out community correction system exsiting coarse, lacking professional team and guarantee system.it analyzes the problems and insufficiency of our country's community correction system from the aspect of legal and administrative.The fourth part gives the echo to the third part,it puts forward the specification and perfect legal system of community correction and relevant supporting system of the concrete Suggestions, to establish a community correction system with Chinese characteristics.
