The Research Of China’s Community Correction System

Being the concrete manifestation of correct socialization, individualized and humanitarian change, community correction is a non-in-prison sentence run system, which takes the characteristics of low punishment cost and good correction result, mainly through the treatments of the criminal personality to realize the re-socialization of criminal. Although the community correction system of china develops lately, which recently have achieved a great progress, because the "criminal law amendment<eight> clearly put forward the applicable scope of the community correction for the first time. At the same time the newly revised criminal procedure law has been clear about the way of community correction. Besides the justice department formulates the measures for the implementation of community correction and puts forward the detailed rules for the implementation of the community correction. Through a series of laws and regulations formulation, we can see that the state of the development of the community correction system to promote strong. However, from foreign development experience and development of our country’s current situation, the government is not everything, the development of community correction from society and wide participation. Based on this, this paper mainly includes four parts. The first part discusses the basic theory of community correction, taking the integration of community correction. Based on a variety of viewpoints from the integration of their views, this paper discusses the various definition, mining out its generality and individual character. Finally this part clarifies the three characteristics from the object of community correction, the nature and the content of community correction. Moreover, this part analyzes several aspects of the value of community correction on exploring the supervision, the transformation, the help and service functions from corrective effect, economic cost and education significance.The second part focuses on the relevant theory of social participation. Firstly This part expounds the carrier of community correction-natural attribution of community and social analysis, leading to the significances of participation in community correction; Secondly, this part also pays close attention the subject, content, form of the social participation in detail s. In consequence, the reader is able to have a more comprehensive understanding of social participation. In the end this part excavates the theory source of social participation, such as social ecological system theory and social interaction theory. After all practice needs the guide of theory. So do the foreign experiences for reference.The third part of this paper refers to the foreign social participation experience, including the American and British Japan. Finally this paper reviews the development course of community correction in China, embracing "Beijing model" and "Shanghai mode" which explains that China’s development of community correction has accomplishments and problems, including lack of legalization guide, out of fund, defective organization, imperfect community construction, incorrect recognition about community correction.Aiming at the lack of social participation in community correction at present, in the last part this paper respectively puts forward some Suggestions from the national policy, capital, organization, correct environment and correct concept advertisement.
