On The Improvement Of China's Parole System

Parole system is an important part in the execution of punishment system and plays an important role in promoting criminal positive reform, repent, and being a new man. Research and improvement of the parole system are a necessary to promote the rule of law, to build and to improve the legal system of the criminal law. In recent years, legal system building has experienced fast development, but China's judicial system is still not perfect, and the criminal proceedings have the following defects "More attention to the trial, Less attention to the implement"; the parole system, one of core contents of the criminal execution is extremely abstract and difficult to operate. It also never has opportunities to become research focus of the criminal law so its operation mechanism has obvious defects and related researches are necessary.To improve the parole system of our country, the paper here starts from practice and makes an analysis of the parole cases in the past three years through a comparative study of the parole system on the basis of an analysis on the concept, nature, function and other information alike of the parole and finds that the parole cases are decreased year by year. Existing parole systems have the following problems including serious tools, not elaborate trial procedures, difficult to inviting external supervisions, not scientific consideration details, difficult to deal with physical conditions, escapes from supervision, over large Prison discretion rights, lack of unified specific provisions of the property punishment, very low applicable rate and so on. To solve these problems, on the basis of the theory analysis and practice, the paper here holds an idea that the independent function of the parole system should be paid great attention to by changing the concept and improve the parole system through improving specific procedures, setting up special parole cases trial mechanism, refining parole court hearing procedures, abolishing restrictions on proportion and other methods and should promote the parole system to play a good system performance and to perfect our parole systems through introducing relevant provisions of the external supervision under coordination, conducting smooth communication between law enforcement agencies and perfecting the community correction legislation.
