Chinese Government Purchases Public Service Legal System Research

Public service supply is one of the important functions of the government.With the gradual development of the government function reform and the innovation of social management,the Chinese government has begun to use the innovative way of purchasing public services to the social forces to fulfill the responsibility of public service supply,to change the inherent "government arranged" thinking.Let the market undertake some public services that the government can't arrange well and the market has the ability to control,namely,create a partnership between the government and the market to speed up the transformation of government functions,improve the supply of public services and meet people's growing diversity public service needs.As the government purchase of public services is related to the public interests and is involved many factors,both economic and social fields,the legal system gradually highlights some problems that need to be solved one by one in the future legislation and practice.This article will be divided into four aspects,first introduce the basic theory of the government public service from the perspective of the government purchase service's concept,the China's exiting purchase model,the legal basis and the application value.Secondly,introduce the implementation status of Chinese government purchase public service legal system,which includes the current legislative status,local government pilot practice experiences and the specific situation of public services and the corresponding problems in the practice.Thirdly,introduce the developed countries' value experiences of purchase public service and the enlightenment to China.Finally,Combined with the problems in our country practice and other countries' valuable experience,put forward corresponding suggestions to perfect the legal system as the reference for its' future improvement.
