Study On The Legal Issues Of Government Procurement Of Public Services

In the purchase of public services,the government is no longer a direct provider,became a buyer,supervisor".The content of the purchase,the purchase mechanism,the fund and the performance appraisal method and so on,have become the content which our government should consider.Thus,how to effectively regulate the government to purchase public services,its importance for the government to purchase public services in the orderly development of self-evident.Although the central and local government introduced a series of strengthening government notice,on the purchase of public services and regulatory advice or interim measures,and achieved some success,but in the whole supervision system there are still many legal problems need to be solved,this paper discusses these problems,and put forward the corresponding suggestions.This paper is divided into four parts:The first part is an overview of government procurement of public services".First of all,the author defines the connotation of government purchasing public service supervision,including the meaning and characteristics of government purchasing public service,and the meaning of government purchasing public service supervision.Then it introduces the theoretical basis of government purchasing public service supervision,including: public governance theory,public service theory,market supervision theory,principal agent theory.Finally,it analyzes the necessity of government purchasing public service.The second part: the relevant regulations and Enlightenment of foreign government's purchase of public service supervision".The relevant provisions in the purchase of public services and regulatory aspects of the United Kingdom and the United States,Germany,the Hongkong government has carried on the correlation analysis,and summarizes the Enlightenment of foreign related provisions of our country: the supervision mode in line with national conditions,to improve the legal supervision system of government purchase of public services,clear the legal relationship between the government and social organizations,the specific the government purchase of public service duties,clear regulatory body of the government purchase of public services and the scope of comprehensive performance evaluation system.The third part: the present situation and the dilemma of the government purchasing public service supervision in our country".First,the Chinese government introduced the current situation of public service purchase supervision,according to the current situation analysis of the predicament: the supervision of the main responsibility is not clear,the content of supervision is not comprehensive,the information disclosure system is not perfect,the performance evaluation system is not effective.The fourth part is about the legal advice to perfect our government's regulation on the purchase of public services".This part of the above mentioned difficulties,combined with foreign experience,put forward specific suggestions: perfect clear government purchase of public service duties,strengthen the supervision of the main content of the supervision of government purchase of public services,improve the information disclosure system and improve the performance evaluation system.
