Along with the rapid development of Internet technology,people cannot leave the network almost every day.Through the network,every day we can actively or passively exposed to all kinds of advertisements.Online advertising broke through the traditional advertising restrictions on time and space,with great flexibility and interactivity,convenient for People's Daily life.However,everything has two sides,online advertising bring convenience to our life and at the same time there is a lot of illegal behavior,the network of false advertising is one of them.Because of the low barriers to entry of online false advertising,regulatory difficulties,high return on revenue,so the network of false advertising emerge in endlessly,there is a tendency to flood,infringe upon the legitimate rights and interests of consumers,or even disrupt the normal social economic order.Our country must pay attention to and accelerate the perfection of the legal regulation of the network of false advertising,in order to adapt to the rapid development of advertising in the internet age.In addition to the introduction,this paper is divided into three parts.The introduction mainly introduces the research background,the domestic and foreign research review and research methods.The second part of the article starts with the concept of the network of false advertising,defines the concept of false advertising on the internet,and elaborates the network false advertisement characteristic and the manifestation,to provide theoretical basis for the study of the legal regulation of false advertising.The third part introduces the status quo of legal regulation of false advertising in our country,and emphatically analyzes the problems existing in the network of false advertising law regulation in our country.At present,our country in terms of regulation network of false advertising mainly exist the following problems:the form of the Internet false advertising,the main body and its legal responsibility is not clear;a single regulator,lack of effective supervision system;the review process of network advertising is unreasonable,the examination efficiency is low.In the fourth part,the author tries to draw lessons from foreign mature supervision and examination system,combines with our country's national conditions,puts forward some suggestions on how to perfect the legal regulation of false advertising in our country from three aspects:standard from the network of false advertising,online advertising regulatory system,online advertising regulation program.Perfecting the standard of the from,subject and their responsibility of the network of the false advertisement and prior review and post review of network advertisement,at the same time,set up dedicated Internet advertising regulatory authorities,create professional Internet advertising supervision team,pay full attention to the power of consumers and industry self-regulation,in the end form a"government-consumer-industry self-regulation" multi-cooperation network advertising regulatory system.The author hopes that can do my best to improve the legal regulation of the network of false advertising.
