The dispatched office is a special component of the administrative organs of our country,mainly includes three types,administrative offices,district offices and street offices.Sent to the organs of China's special historical background,as a link between the government and the masses of the bridge,its existence is very characteristic of the times.The government has played an important role in practice,but with China's planned economy gradually to the transformation of the market economy,the relationship between government and society is constantly changing,sent organs continue to face new problems and new challenges.Therefore,all localities have also tried to carry out the administrative system reform practice on the dispatching organs,which is of great significance to our administrative system reform and administrative organization perfection.Today,the administrative and district offices in the reform gradually revoked,are about to withdraw from the stage of history.While the neighborhood offices still play an important role.The reform of the street offices in Shanghai has also been at the forefront of the country and has made the first progress in the recent street offices.This paper chooses the Shanghai office to conduct an empirical study,from the legal point of view to a comprehensive analysis of its problems in the operation,the contents of the legal system reform and further improve the direction.The main contents of this paper are:The first chapter,from the perspective of public law to sort out the concept of sending organs and history.The dispatched office is an administrative organ approved by the people's government at or above the county level as prescribed by the Organizational Law,and has independent administrative subject qualification.In practice,there are three types of administrative offices,district offices and street offices.Nowadays,the administrative offices and district offices are gradually being revoked,and the street offices are facing reform.The second chapter mainly discusses the legal status of the dispatched organs.The organization law provides the basis for the establishment of the dispatched office,and the administrative procedure law stipulates the qualifications of the administrative litigation defendant.By combing the laws and regulations on the dispatch of organs,and focus on the status of the administrative organs in administrative proceedings.In the third chapter,the author analyzes the problems such as the establishment of the office in accordance with the law,the function orientation,the comprehensive law enforcement and so on,and the solution to the problem.And the analysis of the amendment and further analysis of its legal reform direction.
