The Challenges And Countermeasures In The Personnel Management Reform Of The Grassroots Courts

The the forefront of China's judicial work is grassroots courts,the basic court judge is the most active subject in the judicial activities.As the reform of Judicial System for Specified Number of Personnel is the important part of the judicial system reform,the success or failure of the reform has great significance for the construction of grassroots courts and the construction of the judge professionalization.In out courts there are some serious problems such as the local-type and the executive-type in the establishment of our courts,the non elite team of judges,the administrative personnel management,the unreasonable distribution of work content.With the step by step promotion of the judicial system reform and the introduction of Framework opinions on Several Issues concerning the reform of the judicial system,the trial courts have made different attempts in the reform of Judicial System for Specified Number of Personnel.Although it has achieved some success in the trial courts,but the reform still has some difficulties to overcome.Firstly,this paper introduces the general situation of the basic level courts,the background,the necessity and significance.Secondly,it puts forward some problems such as the lack of the local control,the lack of the legitimacy of the system,and the difficulty of the judge's professional sequence.Finally,put forward some suggestions: to promote the independence of the court and the judge,to amend the relevant laws and regulations,to promote the reform of the judicial system,improve the basic level of the reform of the personnel management system.
