| In recent years, people have paid much more attention to food safety problems, while vicious incidents have been exposed and dealt with in our country. Food recall system is one of the effective ways of protecting food safety. Regulating food recall is helpful to standard the food market’s order, protect the customers’legal rights and enhance the competition among the food production operators. China’s food recall system is developing constantly although it started relatively late. A certain amount of legal and practical experience has been accumulated. Because food recall system is an exotic and a new thing in our country, there are some legal issues inevitably.Compared to developed countries’perfect food recall system, China’s food recall system still exists some legal questions which reflect in legislation, enforcement and law-abiding. Firstly, legislation is inadequate; secondly, authority and responsibility of regulatory agencies is indeterminacy; lately, food recall is difficult to achieve. The reasons are mainly that our legal system is imperfect, regulatory system of food recall is chaotic and the food production operators’illegal cost is too low. Arming at above reasons, as a whole, we need to improve the legal system, rationalize the regulatory system of food recalls and enhance the punishment for the law-breakers. Concretely, we should not only learn about advanced technical experience of developed countries, but also seek after an appropriate legal system of food recall on the basis of our country’s specific conditions. Food security is an interrelated system, therefore, we should improve the food recall system not only set about from itself, but also establish and perfect other related systems, such as food traceability system, food safety standard system, food recall liability insurance system, innocent treatment system. |
