Study On The Legal System Of Food Security Supervision In China

“Food is the paramount necessity for people,as the security is for food.” Food security is strongly associated with people's survival,health and life safety.The rule of law is the fundamental to ensure the food security,and to establish and improve a perfect supervision legal system for food security is a duty to ensure the citizens' basic rights.However,the frequent food security problems shows that the legal system of food security supervision in China is still inadequate.Therefore,improving the legal system to prevent the accidents in food security is an important theoretical and practical problem to be solved for the food security supervision in our country,which is also the original intention and key point of this paper.In addition to the introduction,this article is composed of four parts.The first part defines the concept of the food security supervision at first,which focuses on elaborating the significance of the human rights of the construction of the legal system,and it points out that the food security concerns everyone's basic right,and strengthening the construction of the legal system of food security supervision is a crucial institutional arrangement to protect human rights.At the same time,the article analyzes and elaborates the construction of the legal system in basic theory and the evolution of the history.The second part,on the one hand,introduces the progress in terms of regulatory provisions and the results achieved in the implementation of the food security law,and on the other hand,it analyzes the weakness of the legal system in the macro field and the short of specific construction of the legal system,administrative accountability system and the social co-governance mechanism.The third part comes up with the thought of the countermeasures to improve the legal system of food security supervision in China.In this part,it puts forward that we should fully recognize the important role and function of the legal system of food security supervision in the national governance system.It emphasizes that we should combine the thinking of “good governance” and “co-governance” with the thinking of “ rule of law” in the food security supervision to play its role better,so as to promote the modernization of the capacity and system of national governance.Meanwhile,it stresses the improvement of the socialist system with Chinese characteristics inevitably requires us to roundly strengthen the legal construction of food security supervision from legislation to legal supervision.It also proposes to strengthen the weak links of food security supervision and the construction of specific legal systems,improves the administrative accountability mechanism and the norms of social co-governance and strengthens the supervision of the rule of law and the thinking of the countermeasures to crack down on illegal crimes and so on.The forth part is a summary of this paper.It points out that if we want to reinforce the construction of the legal system of food security supervision in our country,we must enhance the thinking of institution,the rule of law and the system.We can use the institution to manage the fundamental,use the law to manage the normal behavior,and use the system to make it work together,to strive to push the supervision of food safety in our country into the track of institutionalize and the rule of law.In the construction of the comprehensive governance pattern of the supervision of food security in China,it is necessary to recognize the issues of the supervision of food security from the perspective of the protection of the human rights and the modernization of the national governance system and the capacity of the governance and take the strengthening of the weak links of the supervision and the construction of specific legal system as the key measures,and take the improving the mechanism of administrative accountability and the mode of social co-governance,the strengthening of the supervision of the rule of law and the cracking down on illegal crimes in the food field as the important tasks and guarantees.
