Public participation in administrative decision-making is an activity that the public participate in the process of administrative decision-making and interact with the government or other public power authority,trying to influence the result of the administrative decision-making.In the west,the theory and the practice of public participation in administrative decision-making has a certain degree of development.In China,public participation also becomes strong hot social practice activity and administrative subject.Hearings,discussions,the public comment of draft laws and other forms of public participation become the important symbol of the democratization of Chinese legislation and public decision-making.It is a great significance for people participate in administrative decision-making process legally.however,there exists some questions,such as the contradiction between broad public opinion and the cost of involvement or administrative efficiency,the shortage of representation in participation and the lack of authenticity in public opinion,the inherent conflict between democracy and scientificity of the administrative decision-making problems.The practical experience and the legal system of foreign public participation in administrative decision-making,can provide reference for us.The practice of our country's public participation in administrative decision-making activity is still in its beginning stage,the relevant legal system is not perfect,theory research is quite lacking.Public participation in administrative decision-making in our country has many defects,such as,The concept and consciousness of public participation in administrative decision-making is not strong and the participation ability is weak;Legal norms is Imperfect;The subjects is not clear;Participation forms are simple and seriously formal;Process of law is not perfect;The relevant legal system is lack,and so on.To establish and improve the legal system of public participation in administrative decision-making in our country,this article makes research from the constructing and perfecting the perfection of legal system principle,the basic legal principles and the basic content of legal system of public participation in administrative decision-making of our country.
