Research On Prison Assessment System

Prison is the execution organ of penalty,which holds the one who was detained for management,was sentenced to life imprisonment or the death penalty suspended for two years.Punishment and transformation are the core objectives of the prison,which is quantified by the prison assessment system.Through the establishment and implementation of the assessment system,the prison takes the examination results as the basis and important basis for the execution of the law enforcement power for criminals,such as commutation,parole and grading.In the period of the Republic of China,the assessment system of the prison came from the western countries,experienced the development and evolution after the founding of the people's Republic of China,and gradually formed the present assessment system.In this process,the prison assessment system changing from focusing on the heavier punishment to the transformation of reform,form the production of labor to the ideological transformation,from the system itself to the thought of "people-oriented" transformation,gradually legal,scientific,has achieved a significant change in prison penalty execution.Although the assessment system has experienced a process of development and improving,with the change of the ideas and the component of the prisoners,the assessment of prison system still has some problems: general legislation,the same standard in terms of assessment,the importance of labor reform,unsound of the incentive mechanism of criminals,lacking forcing of discretionary power,difficulty of using the offenders assessment after the return of social life.It is the existence of these problems that leads to the fact that the examination results can not objectively reflect the real situation of criminals transformation,nor can they scientifically apply the results of assessment to the performance analysis of criminals after rewards,punishments,grading or even returning to society.In order to solve these problems,this article using methods of analysis and comparison in the legal angle view,combined with the actual prison feedback,putsforward new understanding and research on the new situation under the new environment appraisal system for the prison assessment system,and proposes some suggestions: firstly,perfect the legislation to provide solid supporting;secondly,implement the criminal classification assessment mechanism,make up different standards,methods and contents;thirdly,focus on the education reform,change the transformation of guiding criminals concept;fourth,increase the assessment incentive mechanism of criminal to improve the initiative of criminal reform;fifth,strengthen law enforcement supervision,and perfect the supervision system from different angles;sixth,combine the assessment results with local agencies to achieve the sustainability.Through the above measures,this article hopes to be able to effectively solve the problems of prison examination system at present,lock out the thought from the traditional one,achieve the purpose of prison assessment system,complete the task of punishing and reforming the criminals,and realize the "basic security" of the spirit.
