Since the “Open Courseware” initiative started by MIT in 2001,UNESCO has proposed the concept of “Open Education Resources” in 2002.China started with the National Excellent Course Project implemented in 2003 and began the development of open education resources.After more than a decade of development,China's open education resources have not only become diverse forms,but also have gradually expanded their influence,and people's sense of identity is becoming stronger.Open educational resources play an important role in promoting the improvement of education quality,the popularization of higher education,the balanced development of college students and teachers,the sharing of educational resources among the regions,and the learning of the entire nation.However,with the development of open education resources,the problems that arise during its development have gradually emerged,especially the issues concerning intellectual property rights,which are more special and complex.The protection of intellectual property rights is an inspirational and catalytic role for the development of social civilization and the spread of culture.This is also respect for creators.However,the protection of intellectual property itself is a more complex issue,and open education resources are mainly spread on the Internet.Therefore,the special knowledge dissemination methods of the network environment make the network intellectual property issues more complicated.The rights to use open educational resources are very widely for the audience.But highly creative,innovative,and academic scientific research results,in the absence of effective rights protection,basically no scholars are willing to be free and open.It will lead to sustainable development.This article focuses on the nature and characteristics of open education resources,the current state of research and application in China,the protection of intellectual property rights and the protection of the core,and focuses on the difference between network intellectual property rights and traditional intellectual property rights.Applicable to the research direction of open education resources,identify the intellectual property issues that exist in open education resources,analyze the causes and propose corresponding solutions.This article is composed of four levels,namely,introduction,theoretical basis,problem and reason analysis and suggestions.It is divided into six chapters: Chapter 1 is introduction,the contents of this article,and the meaning of the purpose of this article;Chapter 2,related theory Basics,introducing the basic theoretical knowledge of the related content involved in the article;Chapter 3,the analysis of the intellectual property rights and causes of open educational resources,mainly combined with the current and potential knowledge generated during the current use of open educational resources in China.The issue of property rights is listed for analysis and indepth analysis of the causes to find the root causes;Chapters 4 and 5 are solution strategies;Chapter 4 is to propose corresponding solutions to the legal reasons analyzed in Chapter 3;The Chapter 5 is to provide suggestions for the causes of the open education resources analyzed in the third chapter;the sixth chapter is the conclusion and outlook.This article adopts the literature analysis method,chart analysis method and other means to review the existing research on open education resources at home and abroad,and studies the current situation of China's open education resources and network intellectual property development.This article focuses on the combination of legal research on intellectual property rights and open educational resources,which has played a role in promoting the interaction between the two disciplines.
