The rapid development of knowledge economy makes the protection of intellectual property rights increasing important. When global trade gradually closely combined with intellectual property rights, in form of technology trade, intellectual property trade and so on, intellectual property rights protection work began on the international scope. However, according to the United Nations food and agriculture organization (FAO) report, there were still 842 million people on the brink of starvation during the period of 2011 to 2013. On human food security problem, the orderly development of international trade of agricultural products plays a vital role. Therefore, the protection of intellectual property rights in agricultural trade issues is worth our in-depth discussion and research.This paper starting from the basic problem of intellectual property rights, expounds the theoretical basis of intellectual property, characteristics and the existing international and domestic protection system. In the next stage, paper analyzes its static and dynamic economic affection. Then paper discusses the characteristics of agricultural intellectual property protection system, as well as the affection on agricultural products trade and trade interests. Paper forward elaborates an important content of Agricultural Intellectual Property rights protection-Plant Varieties Intellectual Property (PVP) protection. Taking UPOV and TRIPS for example, paper fully presents international protection system of PVP protection, and analyzes its different significance aspects for developed countries and developing countries.At the empirical part, taking PVP for example, introducing the trade gravity model, and setting the number of the license to new plant varieties and whether to join the international union of seeds as inspect variables, analyzes the effect of PVP protection to the agricultural product export trade of major countries, investigating the influence of agricultural intellectual property protection on agricultural products export trade. The empirical results show that both agricultural exporters implement agricultural intellectual property protection and the export countries implement agricultural intellectual property protection, can effectively promote the development of the country's agricultural products export trade.
