The Study On Origin Criterion Of Australia Free Trade Agreements

With the rapid development of world economic integration and free trade area, the effect of rules of origin grows increasingly. The rules of origin has the characteristics of flexibility and complexity. In the rules of origin, origin criterion is not only a leading and key position, but also to determine the "nationality" of products. Also, the origin criterion can solve the international trade dispute. Therefore, it is important to improve the origin criterion. As a developed country, Australia reached a FTA with China in June 2015. In China, few scholars research the origin criterion of Australia FTA. The origin criterion of Australia FTA is not only concise, but also relatively loose. It is meaningful to develop the economy.This article synthetically uses history analysis, comparative analysis method. First of all, it discusses the origin criterion of different period in Australia FTA, and it concludes the development characteristics and development tendency of the origin criterion. Secondly, it compares the origin criterion of Australia with the NAFTA model and PANEURO model, and it reaches the advantages and disadvantages of the Australia’s. Finally, it displays the current situation and drawbacks of the origin criterion of China FTA, and to put some suggestions to improve the origin criterion of China FTA.This article consists of four parts:The first part is the introduction of the origin criterion. This part starts from the definition of origin criterion by analyzing the WTO laws, FTA and academic world. Then it explains the types and importance of the origin criterion.The origin criterion is a kind of rules which is used to maintain the nationality of the products. Also, there are 2 types of the origin criterion, including wholly obtained criterion and substantial transformation criterion.In addition to, the origin criterion has 3 functions, including trade statistics, guiding international investment, and so on.The second part displays the origin criterion of different period of Australia FTA, and it concludes the development characteristics and development tendency of origin criterion Australia FTA. The Australian origin criterion becomes comprehensive, and it develops stably. Also, the Australia FTA starts to explore a uniform model of the origin criterion, and to strength the flexibility of it.The third part compares the origin criterion of Australia FTA with NAFTA model and EURO model, and it concludes the relationship between them. The Australian origin criterion is more concise than NAFTA and PANEURO model, but the objectivity of the Australia`s is not as good as the NAFTA and PANEURO model.The fourth part demonstrates the current situation of origin criterion of China FTA. It draws the demerits of the origin criterion of China. There is not a uniform model of origin criterion in China FTA,and the origin criterion of China is lack of objectivity. Also, the origin criterion of China FTA has less flexibility than Australia’s. In the last part, it puts some suggestions to improve the origin criterion of China. First, building a uniform origin criterion model; second, improving the objectivity and flexibility of the Chinese origin criterion; third, clarifying the RVC criterion; fourth, completing the specific origin criterion.
