Research On The Sharing Conflict And Governance Of The Intellectual Property In The Agriculture Of Collaborative Innovation Alliance

Today's world, innovation-driven has become an important force driving the development of science and technology, economic development, social development and even national development. The vulnerable innovation capacity is the bottleneck that restricts the economic development in China, which is the main gap between China and developed countries. Collaborative innovation is the only way that improves the agricultural innovation capability of our country.With the "2011 Plan" (colleges and universities innovation capability upgrading plan) proposed, the agriculture of collaborative innovation alliance came into being. Intellectual property sharing throughout the entire process of development alliance in the cooperative innovation, correct understanding and dealing with the conflict of intellectual property sharing, which contributes to the sound operation of the alliance, so as to promote the agricultural science technology innovation, accelerate the popularization and application of agricultural scientific and technological achievements, and enhance the market competitiveness of agriculture.Firstly, introduces the background and significance, research content and methods of this paper. And the domestic and foreign related articles were sorted out and analyzed; Defines the scope of the sharing conflict of intellectual property in the agriculture of collaborative innovation alliance, and clear the research direction; Based on the life cycle theory, the agriculture of collaborative innovation alliance is divided into three stages, this is, the formation stage, the operation stage and the ending stage. Secondly, describe the development of China's agricultural collaborative innovation alliance, and summarize the main mode, development measures, the main results. Then, by using the method of literature and case analysis, the sharing conflict of intellectual property is comprehensively analyzed in each stage of the alliance. This paper mainly analyzes the sharing conflict of intellectual property from these aspects that the assessment of the value of intellectual property, the background of intellectual property sharing, the intellectual property spillover, the ownership of intellectual property with new and created, the distribution of the interest and so on. And analyze the reasons of conflict from the aspects of system security, policy guidance, intermediary organizations and the alliance itself. Finally, combining with the actual development of China's agriculture of collaborative innovation alliance, hope to provide reference for the practice of the agriculture of the collaborative innovation from the legislation, policy support, intermediary services, the partner selection of the alliance, assessment of the value of intellectual property, contract cooperation, the culture, communication and coordination mechanism, incentive mechanism, the distribution of interests and the management of intellectual property etc.
