Analysis Of Foreground Intellectual Property Distribution In Cooperative Innovation Of Technology Alliance

At present, with the rapid development of economy, the technology and innovation capacity of enterprises has been greatly improved, and the new intellectual property rights of enterprises through technological innovation is also greatly improved. At the same time, enterprises for the significance of protecting intellectual property rights is also generally increasing, the number of patent applications increased year by year, reflecting China's intellectual property rights cause has entered an unprecedented high-speed development stage. Technology alliance, as a kind of development cooperation, complementary advantages, benefit sharing and risk sharing of technological innovation cooperation organization, the intellectual property management problem has been hinders one of the important factor to restrict the technology alliance stability and further development, especially in cooperative innovation prospect of foreground intellectual property ownership allocation problem. The foreground intellectual property refers to the intellectual property rights obtained through joint research and development on the basis of investment resources. The background intellectual property rights refer to the intellectual property rights owned by the cooperative parties.The foreground intellectual property rights has strong characteristics of public property, is not easy to define.it is difficult to partition, so it is difficult to manage the distribution of ownership. Under such background, this research focuses on the creation process of intellectual property of Technology Alliance:(1) the sharing degree of background intellectual property; (2) the input of innovation ability. Due to the intellectual property rights allocation problem is often in before the project technology alliance cooperation negotiations through contract way to develop and implement, some non-rational factors of negotiations will also affect the foreground intellectual property rights allocation fairness and reasonableness. Therefore, the study will also analyze the economic value of intellectual property, and point out the influence of economic interests driven on the distribution of the ownership of foreground intellectual property rights. Combined with current situation of the development of the technology alliance, put forward hypothesis on the basis of theoretical research, model construction, through the sample questionnaire survey to collect data, using SPSS 20.0 and AMOS21.0 statistical analysis software, an empirical analysis and test a theoretical model of the data acquisition, to verify the theory hypothesis, analyses the factors influence of foreground intellectual property ownership in technology alliance innovation.Research found that cooperative enterprises within the technology alliance in R&D cooperation projects, the sharing ability of background intellectual property and innovation ability on the foreground intellectual property rights ownership allocation has positive influence and promote the foreground intellectual property rights allocation fairness and rationality; and before the distribution of intellectual property ownership is not complete, intellectual property rights were doing economic value assessment, the foreground intellectual property rights ownership distribution will caused by the negative effect and the interests of the drive, this will make more irrational emotions in foreground intellectual property ownership distribution, thus affecting the fairness and rationality.
