environmental protection win-win situation,which is the only way to achieve sustainable development in China can effectively alleviate the inefficient use of energy and irrational energy structure caused by China's sustainable development in the bottleneck encountered.Low-carbon economy is different from the traditional "high-carbon" mode of economic development,which is characterized by low energy consumption,low emission and low pollution.Under the guidance of sustainable development concept,through low-carbon economy,institutional innovation,technological innovation,new energy development,Industrial structure optimization and adjustment and other means to minimize the consumption of high-carbon fossil fuels,reduce carbon dioxide and other greenhouse gas emissions,economic the "communal tragedy" and "free-rider" phenomenon,to some extent solve the problem of market failure,internalization of the external economy of invention and creation,making the personal income of invention and creation close to social benefits,and thus Effectively inspire the invention and creation,and promote the technological progress of the whole society.Therefore,the protection of intellectual property rights is an indispensable cornerstone of the development of low-carbon economy.It is particularly important for intellectual property protection system to promote low-carbon technology innovation and realize the independent intellectual property right of low-carbon core technology.Into the 21st century,China's intellectual property protection system gradually improved,and achieved remarkable results.However,the level of protection of intellectual property rights in China compared with the Western developed countries,the gap is still relatively large,in general,is still in the development and initial stage,intellectual property protection need to leapfrog development.Therefore,an objective understanding of the level of intellectual property development in China,found that intellectual property protection problems,find intellectual property protection to promote low-carbon economic development and low-carbon core technologies to achieve the best path of independent intellectual property rights,and then develop scientific and rational intellectual property rights Protection policy,will be able to achieve the cause of intellectual property protection and the rapid development of low-carbon economy.Therefore,how to use the scientific and effective method to make a correct judgment and reasonable explanation on the present level of intellectual property protection in China;how is the impact of intellectual property protection on low-carbon economy?The research on this issue is not only of theoretical significance,but also has important practical significance for the country to formulate more effective protection of intellectual property rights and low-carbon economic development strategy.On the basis of intellectual property protection and low-carbon economy theoretical analysis on the following research aspects.First,the protection of intellectual property rights protection measure,the strength of intellectual property protection comprises two aspects:Legislative enforcement of intellectual property rights and intellectual property strength.Our discovery of intellectual property rights legislation has basically reached the level of Western developed countries,but our enforcement of intellectual property rights has been relatively low.Second,the level of China's low-carbon economy measure,measures the net emissions of carbon dioxide and the energy intensity of our country found that the annual growth rate of carbon dioxide emissions and energy intensity of net annual growth rate gradually decline,shows that China's low-carbon economy achieved some success,but the total net energy consumption and carbon dioxide emissions in China each year is still great,low-carbon economy,the task is still very grim.Third,in the year 2000 to 2014 in 29 provinces(except Tibet,Xinjiang,Hong Kong,Macao and Taiwan),based on the panel data,empirical tests of intellectual property protection on low-carbon economy and the introduction of control variables Habitat GDP growth rate energy intensity,population growth,the strength of research funding,the overall regression results show that the strength of intellectual property protection of low-carbon economy has a significant role in promoting additional research funding intensity of low-carbon economy also has a positive effect,while Habitat annual GDP growth,energy intensity,annual population growth rate for China's low-carbon economy inhibited.Fourth,we put forward policy recommendations based on the status quo of intellectual property protection and low-carbon economic development and empirical analysis of the conclusions.
