With the development of social economy,the importance of work-related injury insurance in occupational safety is particularly prominent,and the benefit of work-related injury is in the core of the insurance.However,the establishment of work-related injury insurance system in our country is relatively late,and there is a big difference in the policy because of the territorial management.The level of disability benefit is uneven.Disability grade benefit of work-related injury insurance in our country is worthy of studying.The study on the benefit of work-related injury insurance in China is mainly focused on combing and analyzing the policy,research on different groups and industries and the international comparison of the benefit.The above studies do not reveal whether the level of benefit of work-related injury insurance in China is scientific?If it is not scientific and unreasonable,how to calculate scientific and reasonable work-related injury insurance benefit compensation standards?What theoretically explains the general standard of work-related injury compensation?The study first calculates the degree of the loss of work ability and disability benefit matching degree,then through the literature method and interview method to explore the reasons,finally put forward research problem.The study uses induction and deduction research methods,explaining the general standard of work-related injury compensation in theory.Through the compensation methods of foreign work-related injury insurance,generalizes the standards range of treatment,combine the history of work-related injury insurance in China,finally draw the following conclusions:First,China's work-related injury insurance whether long-term disability benefit or one-time benefit policies are unreasonable.There is asymmetrical between the benefit and the disability grades,regional compensation system is fragmented,compensation level is uneven.Work-related injury insurance payment and disability level is asymmetry.China's work-related injury insurance disability benefits policy formulation is unscientific and unreasonable.Second,the nature of work injury is a kind of tort liability,the change of responsibility for work-related injury experiences employee's liability,fault liability,strict fault liability to no fault liability,the nature of compensation under the framework of social insurance is quota compensation between employers and employees;theoretically deduced the grading of the loss of work ability of work-related injury insurance's disability benefit is actually equal to the wages of the loss of work ability.Third,through the analysis of 128 countries or regions,the long-term payment of subsidy is the mainstream of the payment of total permanent disability treatment.The treatment model is:treatment coefficient*treatment base*treatment period =Total permanent disability treatment;Partial disability:A percentage of the full pension is paid according to the total full permanent disability benefit.Fourth,based on the theoretical explanation,experience of foreign work-related injury insurance benefit and the historical policy of compensation for industrial injury insurance in China,the calculation model of the high middle and low grade program of the work-related disability insurance in China is as follows:DT=-a*l*w*(t1-t2)+(29-2n)*wDT is the treatment of disability,a is the disability coefficient,l is the ability to work for the loss or the percentage of disability,l?(75%-100%),n?(1,2,3,4,5,6),w is for the salary,t 1 is the retirement age,t2 is the disabled age.The coefficient of the high-grade program is 90-100%;the coefficient of the mid-range program is 80-89%;the coefficient of the low-grade program is 70-79%.Fifth,one-time work-related injury insurance benefit in our country existence necessary,the disabled people intend to choose the payment method.The one-time benefit standard should be equal to the discounted long-term subsidies amount consistent with corresponding to disable grade.
