Limited Property Housing as a result of Chinese products have been living for nearly two decades.Under the provisions of national laws and policies,land can not be sold,transferred or leased for non-agricultural construction,any construction require to use the land must apply for state-owned land.Because the Limited Property Housing violated the national law,it has been regarded as illegal by the government departments.At the same time,the government is eager to solve the problem.However,social demand for Limited Property Housing right is too big,this illegal subject not only continue to survive,but also got a broad space for development in the rural areas.As early as 2012,some research showed that from 1995 to 2010,the whole country added a total of 760 million square meters of Limited Property Housing.Now,when buyers hope that the state recognized Limited Property Housing,the national authorities banned the construction of the Limited Property Housing and business behavior.How to judge this social problem,especially how to solve it,has become an urgent research topic.In order to explore why the Limited Property Housing was identified as illegal individuals.In this paper,by describing the produce process of legitimate homestead room,we found that Limited Property Housing violated two provisions of the state: the legitimate homestead is only available to members of the collective economic organization,urban residents can not build and buy houses in rural areas.Due to the inability to obtain a real estate license,Limited Property Housing naturally can not get the protection of the law.However,why is this illegal individual so popular,there must be a detailed reason.In this paper,by describing the historical background of Limited Property Housing,we found it was produced when the transitions of planned economy to market economy,large migration of rural population to the city and urbanization is developing rapidly,which seems to be the inevitable result of social development.On the other hand,this paper analyzes the behavior motivation of the construction and sale of Limited Property Housing,and finds that it is also the inevitable result of human nature.In the face of the inevitable product,it is necessary to carry out a comprehensive,objective and impartial investigation.In order to restore the true face of the Limited Property Housing,in this paper,the positive and negative effects of Limited Property Housing are analyzed in depth.TheLimited Property Housing has been playing a significant role in solving the general public housing demand,balancing housing prices stabilize,rich farmers,promoting the balanced development of urban and rural areas and promoting the development of small towns.But it also exists bad behavior of infringe upon national interests,undermine government and legal authority,and create contradictions.For the Limited Property Housing was criticized the illegal problem,this article analysis law and legal perspective respectively,and demonstrated the fact that the Limited Property Housing exist illegal facts objectively,but the reason is not insufficient reason for illegal.At the same time,in order to understand the Limited Property Housing more fully,this paper.This article from the side to understand the "birth of its mother"--the most talked about the right of the small town.It is found that there is a striking power in cracking the plight of small town development,stimulate the development of small towns and promote the wheel of city group development.In order to clarify the Limited Property Housing right way,three paths come from the reality: the removal of all,continue to hold and take measures to legalize,are analyzed separately.Finally concluded that the overall removal is not feasible,it is impossible to continue to shelve,we must to take measures to legalize the conclusions.According to the problem-solving ideas should be transformed sooner rather than later,when we have determined the direction,we should build the transformation strategy of Limited Property Housing as soon as possible.Limited Property Housing room due to the big thing,could trigger a chain reaction,causing serious consequences.In this paper the design countermeasures identified four basic principles" ensure that the total arable land is not reduced,ensure that the buyers interest does not reduce the total,ensure the interests of the collective is not reduced,ensure the legitimate homestead nature does not change".On the basis of comprehensive analysis,based on the "change hang" and "balance","property rights"results of case thinking,learning the essence of the reform process of Yujiang legitimate homestead system,according to city residents and farmers two kinds of different attributes like,the author puts forward the innovative proposed "legitimate homestead replacement model" and the "commercial housing replacement + government acquisition mode solutions.
