Study On Rent Seeking Of Bidding And System Supervisionin In Construction Project

The bidding mechanism originated from the United Kingdom,it is widely used in the world.Contracting mechanism as a special commodity transaction,Tendering and bidding system has been used in construction project transaction,government procurement,land tenure,transformation of mining right,State-owned property right transaction,franchise right,pharmaceuticals,international procurement of mechanical and electrical products.The bidding mechanism has been lead-in China in 80 s.Up to now,it accumulated more than 30 years of development experience.Bidding of construction projects for the construction market even produced a huge role in the healthy development of the market factors,the "open,fair,justice" and "honesty and credit" principle to meet the needs of the development of the market,to create a healthy market order,to achieve the optimal allocation of social resources,and actively play an important role of the market in resource in the configuration,greatly promoted the international standards of the construction industry in china.However,compared with the relatively mature bidding system abroad,China's bidding system implementation time is short,there are many defects,but also produced a series of problems,such as illegal bidding,illegal subcontracting and corruption of rent-seeking phenomenon,especially in the construction project bidding activity is more obvious.Construction project bidding activities in the event of rent-seeking,not only the quality and safety of engineering entity constitute a threat,may also lead to crime,corruption,and seriously undermined the market order of fair competition lead to market failure,greatly restrain the decisive role of the market in resource allocation process.The problem of rent-seeking bidding of construction projects is reflected in the transition period how to deal with the relationship between government and market,the community needs to give enough attention,benefit by mutual discussion of common governance.The causes of rent-seeking bidding of construction project is very complex,this paper summarizes and compares the domestic and foreign existing research results,combined with the real case of great influence in recent years,the domestic construction project bidding rent-seeking and the status of the general form described;from the rule of law,system,mechanism and main motivation analysis summarize the reasons and put forward the idea of governance,to provide a reference for the reform of the public bidding.
