Research On The Protection Of Forest Farmers' Rights And Interests From The Perspective Of Ecological Public Welfare Forest Division

In the new century,with the rise of the need to balance the ecological interests as well as to promote economic development,the reform of Chinese collective forest right system has entered a new stage calling for sustainable development.Inparticular,the enhancement of the main consciousness of the forest farmers results to the problem of the protection of their rights and interests in the division ofecological public welfare forest.And recently the problem is becoming more and more important.However,in practice,due to the contingent definition of public welfare forestand the deviation in understanding of the type of public welfare forest,it is often lack ofprotection of forest farmers' rights and interests,which will gradually cause the missing of the forestry ecological and even the social value.To solve this problem,we need to uphold the idea of sustainable development,not only to attachimportance to the role of public welfare forest in the aspect of maintaining ecological construction,but also to avoid ignoring the protection of forest farmers' interests.Through the perfection of laws and regulations,the broadening of the way to practice,the improvement of the compensation mechanism and other means to get rid of the irrational factors in the system of forest rights,ultimately,we can achievea win-win situation of both the ecological value and economic benefits.This paper is divided into fifth parts as follows:The first part brieflyintroduces the background of the problem which will discussed in this paper.The second part summarizes the concept of the division of ecological public welfare forest,and then analyzes the nature and problemsexisting ofthe division of ecological public welfare forest in China.This paper holds the view that the division ofecological public welfare forest belongs to the category of regulatory levy.The third part introduces the contradiction between the division ofecological public welfare forest and the protection of forest farmers' rights.The analysis finds out that it isthe lack of the protection of forest farmers' rights that causes this contradiction.And then the paper further discussesthe theoretical and practical basisoffullyrealizing forest farmers' rights and interests.The fourth provides some suggestions on how to realize the protection of forest farmers' rights from the perspective of ecological public welfare forest.There are mainly three levels to elaborate: improve the relevant laws and regulations,improve the ecological compensation system and forest farmers' protection mechanism,and protect the four specific rights and interests of farmers.The fifth part is a conclusion of the whole paper.
