Friendly Land Expropriation And Relocation Compensation Based On Power

In the process of urbanization,land requisition and demolition triggered a series of economic and social problems,which greatly hindered the development and construction of a harmonious society.In order to promote the high-quality and efficient development of the county economy,the development of a friendly land acquisition and relocation system is a policy for building a harmonious society.This article takes Mian County of Shanxi Province as an example,through consulting literature,field investigation and analysis,combining theory and practice,based on administrative power,collective land ownership and contracted management rights,interests of relevant stakeholders,proceeding from the actual situation of land acquisition and demolition,analyze the main problems and causes in the land acquisition and demolition,explain the Guiding ideology for friendly land acquisition and demolition in Mian County,and propose to build a friendly land acquisition and demolition compensation,which requires establishing an equal citizen participation mechanism and strengthening the construction of land acquisition and demolition and the implementation of transparent and standardized land acquisition and demolition and improvement of the security system for landless peasants.The most effective way to maintain social harmony is to achieve the harmony between land acquisition and demolition and social harmony.The main contents and conclusions of the thesis research are as follows:(1)Through research and analysis of the natural environment and economic development conditions of Mian County and the current land acquisition and demolition system,it is concluded that as the population economy develops,the area of the city continues to expand,and if the system of land acquisition policies cannot keep up with the current the state of economic development in the city will trigger a series of land acquisition and demolition issues.First,the current compensation and resettlement standards for land acquisition and demolition are inconsistent with the current economic level,which failing to fully protect the rights and interests of relevant stakeholders;second,the exercise of administrative power in land acquisition and demolition cannot yet be strictly enforced in accordance with the law;Third,the demand for construction land is increasing.It is difficult to meet the demand for a single land acquisition,and urgently necessary to enter the market for collective construction land.(2)Based on the relevant laws,based on its connotation,principles and theoretical basis,this paper discusses how to build a friendly land acquisition and demolition model.From the case of land acquisition in Nanhai District of Foshan City and Mian County of Shanxi Province,based on the fairness of relevant powers of various types,friendly land acquisition and demolition model is proposed:First,We should work out a compensation standard that is consistent with the local economic level and protect the interests of those who have lost their land.Second,we must establish a transparent land acquisition model and exercise administrative power according to law.Third,stakeholders should jointly participate in the land acquisition and demolition process to ensure the fairness of power.Fourth,there must be a good external public opinion environment to supervise the legitimacy of various types of power.(3)Develop friendly land acquisition protection measures.With the people-centered principle,allow land-retained property owners and relevant stakeholders to participate in the land acquisition and demolition activities to protect equity;implement land acquisition in the sun and lawfully land acquisition;to improve the quality of the implementers of the land acquisition policy,act according to the law,grasp the correct orientation of public opinion,and guarantee the smooth information,create a good public opinion environment,promote the collective operation of construction land into the market and improve the construction of land supply and demand mechanism.
