Analysis Of China Patent Quality Problems And Countermeasure

Currently,under the background of knowledge economy,the status of patents has become increasingly prominent in the social and economic development due to it’s unique high value-added and irreplaceable characteristics,which has become the core elements of the strategic resources and international competitiveness supporting the sustainable development of the country.In the keen international competition,people pay more and more attention to master the core technology and control of patent rights for gaining the advantage of market competition.In recent years,our government attaches great importance to intellectual property work,the intellectual property strategy has been enhanced our country’s third-largest strategy,the number of patents has made leapfrog development with the help of variety of policy measures,and the number of Chinese patent applications has been five consecutive years Ranking first in the world from 2011 years.But a series of problem emerge,such as low patent quality,lack of core and strategic patents,low-level patent,low patent conversion rate,the core technology of external dependence and the competitive strength of patent issues though the number of patents increased rapidly.The overall quality of Chinese patents and the United States and other developed countries still exists a big gap.This paper uses the patent measurement method to compare the effective patents output and the patent intensity distribution with the data of the valid patents related data between China and the United States between 1995 and 2015 with the aid of Innography patent analysis system.And then the paper analyzes the distribution of IPC technology subject and the number of patent rights in high-intensity core patent in China and the United States to reveals the relationship between Chinese patent and US patent in terms of patent output and intensity distribution.The paper also analyzes the top 100 patents varies general strength and important patent from the core patent in China and the United States as the point to mining the quality of China’s patent quality of the underlying causes in terms of the patent proportion of the patentee,the litigation,the number of patent claims,the patent citation and cited,the international application.The paper puts forward some suggestions on how to improve the quality of patent in China from the perspectives of adjusting the government policy guidance and enhancing the independent innovation ability while focusing on the analysis of the quality of patent in China.The technology innovation talents is the key to the implementation of intellectual property strategy which build a patent power country,The inventor team of the two countries can represent their patent creation ability,In this paper,the inventors’ patents of China and the United States are compared and analyzed which can clearly analyze the quality of Chinese patents,especially the comparison of the inventor country and the patentee country can better explain the quality of Chinese patent the underlying causes.The paper systematically analyzes the overall situation of the patent output and quality in China.The paper has unique innovation in the analysis of sample selection and analysis.The analysis and research are helpful to reveal the problem of patent quality.The research work is of great significance to the improvement of patent quality in China which both have important theoretical and practical significance.
