As the intellectual property plays an increasingly important role in the global market competition, the world attaches great importance to take intellectual property as a strategic weapon to explore and gain a competitive edge in the international market and, basically formed a integration strategy attack mode with patent strategy as a leader and to trade secrets, trademark strategy, copyright, intellectual property strategy as supplements. Late start of intellectual property rights in China, the role of intellectual property rights in are far from being reflected in the process of economic and social development. It is very important for China to learn from the successful experience of developed countries and build innovation-oriented country. Over the years, Japan and the United States dominate advantage of maintaining the world's top two positions in terms of patent applications, and also ranked the world's top two in PCT international patent applications for many years. At the same time Japan and the United States have been the top two ranking the total applications of all countries applied patents in China, and with great advantages in the number of patent applications compared with countries in the forefront, all of which show that of Japan and the United States has a strong ability to innovate and apply intellectual property rights. Their successful experience, especially their experience to get the market competitiveness by virtue of patent is a leading card. This article searched all the published patent applications of Japan and the United States since 1985 in China through "Chinese Patent Database" published by Intellectual Property Office, and analyzed the layout and characteristics of patents of Japan and the United States in China from the number, patent types, IPC technical subject distribution, the legal status of patents and patent holders and other point of view with the method of patent quantitative analysis. Accurately grasping the successful experience of Japan and the United States through the real data is the premise to make suggestion for the development intellectual property in China.Through the systematic analysis, the facts can be found that the patents of Japan and the United States which mainly are invention patents are not only amazing in the quantity, but also maintain a long cycle and higher patent quality. At the same time their patented technologies highly concentrate in high-tech fields, and R&D themes keeps up with market demand.The innovation of thesis work:1 The number of patent applications from Japan and the U.S. in the world is very large, and it is almost impossible to access them all. At the same time the data from patent agencies in different countries will also be difficult to operate, and then the analysis can not be carried out smoothly. The thesis choose patent applications of Japan and the U.S. in China as samples for an analysis, which addresses the difficulties of data acquisition and processing, and the analysis and conclusions are of a stronger reference for the present stage in China;2 Through the"China Patent Database" of Intellectual Property Publishing House of the Intellectual Property Office in China, all the patent data which a "Japanese" or "United States" appeared in the " Address of the Patentee"or "National and Provincial Code" field was downloaded and then accurately screened so that the data was assured true and complete;3 The Analysis on the intellectual property policy of Japan and the U.S. with the method of patent quantitative based on the true and complete fact which made the analysis more empirical. The strategies of enterprises and the state are inextricably linked. The paper overcomes the limitations of a single argument by combining national level with the of enterprise level.
