Research On The Impact Of Intellectual Property Trade Barriers On Chinese Export

Today,WTO advocates the free trade,making traditional trade barriers such as tariff barriers become less and less effective,which has led to the gradual realization of zero-tariff trade between countries.Clearly,the use of traditional trade barriers by importing countries has not been able to prevent other countries from competing for their own market.In order to protect domestic enterprises and maintain domestic products market share,importers innovate a new type barriers--intellectual property trade barrier,which seems to be legal.Especially for the developed countries,they can rely on technical superiority to achieve the purpose of trade protection.In terms of products exported by enterprises in our country,which are involved in the low content of technology and low added value.At the same time,the products imitate of the products of developed countries.when these products are exported to developed countries,the products may infringe intellectual property right easily.It causes the western developed country to bring lawsuit against our enterprises,so exporting enterprises in our country will pay the price.China is a major trading country in the world,and its foreign trade volume is increasing year by year,but its frequency of foreign intellectual property trade barrier is getting higher and higher.The effect on our exporting enterprises is becoming more and more serious,which affects the healthy and sustainable development of China's foreign trade.Chinese export is facing the serious challenge of intellectual property trade barrier,which poses a serious threat to Chinese export trade.Chinese export enterprises have suffered from various forms of intellectual property trade barriers,mainly including 337 investigation,technical standard intellectual property trade barrier,intellectual property abuse and trademark rush and so on.Our export enterprises involved in intellectual property rights trade barriers are widely distribution of industry and the implementation of intellectual property rights trade barriers increases based on European Union,the United States and Japan.As a result,Chinese export volume is reducing and the cost of export is increasing.It also hinders Chinese technological progress and weakens our export competitiveness.There are many reasons for intellectual property trade barrier.External causes mainly include trade protection,trade friction and the establishment of international system of intellectual property by developed countries;The internal reasons mainly include the weak consciousness of independent innovation of our exporting enterprises and the lack of intellectual property strategy and the lack of awareness of the result of intellectual property rights.Facing the challenge of intellectual property trade barrier,our country should start from the following three aspects:Firstly,our enterprises should cultivate intellectual property awareness and our country should participate in the establishment of international rules actively to cultivate andshape the ability to respond to the trade barrier of intellectual property rights;secondly,By taking full advantage of the TRIPs agreement under the WTO system and carrying out the investigation on foreign trade barriers to use existing legal mechanisms of intellectual property rights flexibly;Thirdly,We will begin to improve the domestic intellectual property law system,such as formulating and developing the protection standards and refining existing procedures.
