Based on protecting rural residents' land property rights and interests,"Homestead's capitalization" is occurred for the entire property rights which allows the transfer of homestead over the wider spatial and temporal range.The process is aimed to improve the allocate efficiency of land resources and increase property income of rural residents,which leading to the achievement of equal rights and benefit-sharing between urban and rural residents.There is a heated discussion on the "Homestead's capitalization".The opponents claimed the status quo.From the perspective of"collective-welfare-fair",they pointed out the unshakable institutional arrangements of Homestead-the limitation of laws or institutions-to prove the huge potential risk of reform.On the other hand,supporters held a change in the status quo.They used the perspective of"individual-capital-efficiency" to certify the unstoppable trend of "Homestead's capitalization".In their views,reform satisfies the most contemporary social reality and contributes to revenue sharing between urban and rural areas,which reflects real needs of the community change.Obviously,the argument above is a mirror for difficult reality of homestead system reform.The thesis tries to explore the possibility of realization on "Homestead's capitalization" in legal framework on account of the practical cases.In addition to the description of the specific practices,the thesis focuses on the effect of the practices in order to have supplements and responses for theoretical discussion in Chapter two.As a result,the thesis chooses urban and rural communities gathering practice-let rural residents to live in urban area-in Yiwu as observe case and describe its operation of high-rise apartment to analyze the poverty rights transformation before and after the practice.By examining the field research's outcomes,the thesis draws conclusions on the protection of rural residents' property rights,advantages and disadvantages of "Homestead's capitalization".Finally features and applicability of this case is summarized.The results show that the practice in Yiwu not only helps give rural residents a more complete property rights,but also optimize the allocation of resources of urban and rural land,leading to synchronous urbanization between population and land.That is what is a possible approach could be achieved.Otherwise,there are some problems at the operational level-for instance the respect of rural resident's willingness and reasonable equity conversion-need to be solved.Perhaps,the remaining problems would be the direction for future researches.
