Research On Patent Risk Management Of Optical Transceiver R&D Project Of S Company

As public information,patents include 90% to 95% of the world's technical information.Patents can be used for competitor analysis,technology tracking and forecasting,identification of major technological developments,international strategic analysis,and monitoring of patent infringement,thereby shortening R&D time,reducing R&D expenditure,and improving the performance of technological innovation.At the same time,the risks brought about by patents also exist in every aspect of patent activities,including: technological R&D risk,patent protection risk and patent operation risk.However,a large number of companies lack patent consciousness.In the risk management of R&D projects,the risks caused by patents are often overlooked.This has led to problems in the direction of R&D,repeated technological development,and even serious patent infringement.Therefore,the introduction of patent risk management from the initial stage of R&D projects and the systematic and scientific patent risk management under the guidance of risk management theory are of great significance for the successful implementation of R&D projects.Based on the theoretical basis of risk management theory,patent risk theory,TRIZ theory and enterprise patent strategy system,this paper studies the patent risk management of S company's optical transceiver R&D project.First,based on the background of patent dispute between S company and Finisar company,the project's objectives,organizational structure,and existing patent issues of S company's optical transceiver R&D project were introduced.Then,according to the life cycle of the project,the risk management tasks of each stage were planned,and the tools and processes of the risk management process were determined.Then,based on the patent analysis of the “optical transceiver technology” industry development,competitors,and infringement patents,the brainstorm method was used to identify and classify the patent risks of S company's optical transceiver R&D projects.The expert rating method,risk probability and impact matrix are used to rate the risk,and then the risks are analyzed one by one according to the level of risk,and countermeasures and monitoring methods are proposed.Finally,patent risk management was successfully implemented on the company's optical transceiver project,and achieved a series of accomplishment,which provides experience and lessons for future patent risk management.Based on the research of patent risk management of S company's optical transceiver R&D project,it is found that the introduction of patent risk management in the early stages of the project,can effectively reduce the impact of patent risk,and ensure the results of technological innovation.The patent information analysis methods,patent risk identification methods,risk assessment methods,risk response measures and risk monitoring measures described in this paper can provide reference for patent risk management of other companies,avoid patent risks and improve the success rate of technological innovation.
