Research On The Legislation Of “River Chief System” In China

In 2007,Wuxi created the “River Chief System” for solving the Taihu's water crisis.From its innovations in water control methods,department cooperation,assessment and supervision,formed a powerful force to control water pollution,and soon spread to the whole country.The newly revised Water Pollution Prevention and Control Law in 2017 wrote the “River Chief Institution” into the law.It means that “River Chief Institution” starts to enter the establishment of the legal system.“River Chief Institution” is an institutional innovation.It is a kind of river protection institution in which the government leaders at all levels act the“River Chief ” to supervise and coordinate the prevention and control of water within the jurisdiction,promote or coordinate the government and relevant authorities to perform their statutory duties and deal with the problems of their responsibility waters.It's characteristics including clear responsibilities,systematic governance,specific tasks and strict assessment.At present,in addition to the principled provisions of the Law on the Prevention and Control of Water Pollution in China,only the three provinces including Zhejiang,Hainan and Jiangxi have formulated and promulgated local regulations for the implementation of the “River Chief Institution”.The local legislation of the three provinces established the statutory organization system and statutory work responsibilities of“River Chief”.It stipulated the work system of inspection,interview and problem handling of “River Chief System”,which made it into the locality from the emergency policy.However,there are still legislative defects such as unclear subject responsibility,imperfect management system,and imperfect supervision mechanism.We should activelypromote the River Chief Institution's legislation and accelerate the introduction of local laws and regulations to improve the specific provisions of the River Chief Institution to clarify the statutory duties of the River Chief and related responsible departments.And establish an information disclosure system and public participation system that cover the work of the River Chief Institution.Then establish and improve a systematic and comprehensive cross-regional cooperation system and the presidential conference system.Finally,improve the supervision mechanism of the River Chief Institution,and build a relatively complete River Chief Institution's legal system.
