Study On Emergency Legal Mechanism Of Sudden Environmental Events

The sudden occurrence of environmental emergencies in China in recent years has caused serious damage to the development of ecosystems and social economy,threatening national security and the personal safety of the people.Therefore,the construction of emergency legal mechanisms for sudden environmental incidents is very important in emergency response to environmental emergencies.At this stage,China's emergency environmental incident emergency legal mechanism cannot provide effective guidance and support for the response to sudden environmental incidents.The outstanding performance is as follows: First,the legislation is lagging behind and lacks maneuverability.The emergency legal mechanism for sudden environmental incidents in China is s cattered in the Constitution,the Emergency Response Law,the Environmental Protection Law,and some local laws and regulations.There is no specific law and it has certain dispersion.Second,the functions of various emergency law enforcement agencies are cross-cutting,the powers are unclear,the information disclosure of sudden environmental incidents is slow,and the public cannot effectively participate in the incident response,which increases the difficulty of event relief.Third,there is a lack of ecological compensation system and restoration and reconstruction system in the late disposal.Therefore,based on the reality of the response of sudden environmental events in China,this paper discusses from four parts,namely: The first part,Introduction.The second part,summarizes the related concepts of emergency legal mechanism of sudden environmental events,that is,the concept and characteristics of sudden environmental events and their emergency legal mechanism,and expounds the main contents of the emergency legal mechanism of sudden environmental events in China.The third part,taking Lanzhou water pollution case as an example,analyzes the practice status of China's emergency legal mechanism in sudden environmental events,and discusses the existing problems from three aspects of legislation,supporting system and later disposition respectively.The four part,on the basis of correctly understanding the defects of the emergency legal mechanism of the current sudden environmental events,this paper puts forward some perfect suggestions from three aspects of legislation,supporting system and late disposal.
