Research On Public Participation System Of Environmental Protection

This paper takes the public participation system in China's Environmental Impact Assessment Law as the research object.China's economic and social development has shown a rapid development trend,and the economic aggregate has already ranked second in the world,but environmental quality does not match economic development.While the economic aggregate continues to expand,China's environmental problems are not satisfactory.The environmental pollution crisis has become a major social issue of universal concern,and effective protection of the ecological environment has become one of the key factors for the sustainable development of modern society.The environmental impact assessment system plays an important role in regulating economic development and environmental resource sustainability.Public participation plays a key role in the environmental impact assessment system.On the one hand,it is the embodiment of public environmental rights,on the other hand,it is democratic politics.Inevitable requirements.Public participation in environmental impact assessment can not only enable the public to participate in environmental protection,but also early to find problems in project construction,and put forward scientific and reasonable suggestions to solve problems in a timely manner.However,in reality,in recent years,the frequent occurrence of environmental accidents and the frequent reports from the news media can feel that the public participation in environmental impact assessment in China has not been implemented,and the effectiveness of public participation has been greatly reduced.There are many problems.waiting to be solved.From the perspective of public participation,this paper firstly analyzes the concept and development of the environmental public participation system,and the theoretical basis of its existence.It explains the importance of environmental public participation from the theoretical and practical significance.Secondly,it introduces the legislative process,the status quo and the inadequacies of China's environmental public participation system,especially the development of the public participation system of environmental impact assessment.The main body of public participation is not clear,including the public scope of the public participation is not clear and the public Lack of enthusiasm for participation;insufficient information disclosure,timely and active disclosure of environmental impact assessment information;participation in a single form,using questionnaires,hearings,etc.,the public can not actively choose the form of participation,the hearing system is not binding,The effectiveness of participation cannot be effectively guaranteed;the problems of the system are not perfect.Then it analyzes the public participation system of environmental impact assessment in foreign countries,seeks valuable experience in legislation and practice abroad,and provides reference for improving China's system.Finally,in view of the previously discovered problems,combined with foreign relevant governance experience,some suggestions for the public participation system of China's environmental impact assessment are provided.It is hoped that the public participation in environmental impact assessment in China can be improved,thus improving the environmental public participation system.
