The Research On The Legal System Of Enterprise Environmental Information Disclosure

Enterprise environmental information refers to the information that the enterprise,as one of the members of the society,makes public to the society in order to fulfill its social responsibility about the environmental impact of its production and business activities.Enterprises have always played a major role in polluting and damaging the environment.Timely disclosure of enterprises' environmental information can supervise enterprises and prevent them from polluting and damaging the environment.Improving the legal system of enterprise environmental information disclosure is conducive to promoting enterprises to fulfill their social responsibilities.To protect citizens' right to know about the environment;It is advantageous to the citizen to supervise the enterprise the pollution discharge behavior;It also helps the government make more scientific laws and policies based on this information.At present,the legislation about enterprise environmental information disclosure in China includes the legislation at the national level and the legislation at the local level.National legislation includes Environmental Protection Law,Clean Production Promotion Law,Circular Economy Promotion Law,Environmental Information Disclosure Measures for Enterprises and Institutions,etc.There are also individual pieces of legislation in different fields,including The Law on the Prevention and Control of Air Pollution,the Law on the Prevention and Control of Water Pollution,The Law on the Prevention and Control of Soil Pollution and The Law on the Prevention and Control of Environmental Noise Pollution.There is relatively little legislation at the local level,and the relevant laws and regulations are not very sound.Legislation at the local level is mainly made by the people's congresses and their standing committees in each province,such as The Regulations on the Prevention and Control of Water Pollution in Hebei province and The Regulations on the Prevention and Control of Air Pollution in Shanghai.In practice,the legal system of enterprise environmental information disclosure in China has been established preliminarily,which enables the work to be carried out smoothly.However,there are still many deficiencies in this legal system,such as:the relevant legislation attaches more importance to post-event punishment and less importance to source prevention;Lack of coordination between relevant laws and regulations;The scope of obligation subject of information disclosure is narrow;The form and content of the disclosed information is incomplete;Low public participation;The punishment means and follow-up legal system for illegal enterprises are not sound;Local government supervision is not in place.The advanced experience of enterprise environmental information disclosure system in developed countries such as the United States and Taiwan should be used for reference.By summarizing the legislative experience of environmental information disclosure of overseas enterprises,this paper aims to enlighten the legislation of environmental information disclosure of Chinese enterprises.By referring to the advanced experience in the field of environmental information disclosure abroad,this paper analyzes the environmental information disclosure system of Chinese enterprises in detail,and the improvement of relevant legal system should be based on the following aspects.Second,improve the coordination between relevant legislation;Third,expanding the subject scope of enterprise environmental information disclosure obligation;Fourth,improve the content and form of environmental information;Fifth,improve public participation;Sixth,the punishment means and supporting legal system of enterprise environmental information disclosure should be improved.Seventh,improve the management of environmental information disclosure by local governments and relevant departments;Start with these seven areas.
