| The Air Pollution Control Law revised in 2015 has a special chapter that provides for joint prevention and control of air pollution in key areas,and has officially established a legal system for joint prevention and control of regional air pollution.The research in this article aims to explore the basic connotation,status quo and problems of the implementation of the regional air pollution prevention and control legal system.Based on China’s own ecological civilization construction,it draws on relevant experiences from outside the country and proposes countermeasures to promote the implementation of the regional air pollution prevention and control legal system.The first chapter is guided by game theory,inter-government competition theory,collaborative governance theory,and regional governance theory.It focuses on the three characteristics of the implementation of the regional air pollution joint prevention and legal system,namely cooperation,cross-regional and holistic.From the two aspects of the regional joint prevention and control and the implementation of the legal system,the overall implementation of the regional air pollution prevention and control legal system will be described.The second chapter first explores the current status of the implementation of the regional air pollution prevention and control legal system from the three levels of law enforcement,judicial and legal supervision and analyzes the problems of joint air pollution prevention and control in the evolution of the legal system.The third chapter uses comparative research methods,mainly expounding the experience of the United States and European Union’s two advanced economies on joint prevention and control of atmospheric pollution,and by comparing and generalizing their commonalities and personalities,and then enlightening China.Chapter IV is based on the previous theoretical and practical research,and still proposes countermeasures or suggestions to promote the implementation of a comprehensive legal system for the prevention and control of regional air pollution from three levels: law enforcement,judicial and legal supervision.Promoting the implementation of the regional air pollution prevention and control legal system is the key to implementing the regional air pollution prevention legislation and improving the effectiveness of regional air pollution control.China should take effective measures to promote the improvement of regional joint law enforcement,judicial and legal supervision mechanisms,and provide effective institutional guarantees for the implementation of regional joint prevention and legal systems. |
