Study On The Legal System Of Joint Defense Joint Control In Air Pollution

In recent years, severe haze has appeared in different areas of China. Atmosphere pollution is a quite serious problem. The air quality level is constantly in a low place. Our residents complain a lot. Therefor government of China issued a series of measures to control air pollution, for example, adjusting the structure of the energy industry, wide spreading the utilization of pollution-free new energy, implementing regional limited approval system and the vehicle limit system etc. The air pollution situation in our country got an improvement after these measures. However, because of the mobility of the atmosphere, only rely on the local government and enterprises of the pollutant place, we cannot get success efficiently. We must seek the cooperation of the governments and the environmental protection authorities in different provinces. To control air pollution in region-connecting way would be a effective measure to save our air. At present, China’s relevant departments have recognized the importance of joint prevention and control of air pollution and built a corresponding mechanism in the Olympic Games, the world expo, the APEC meeting etc. And we got good results. But this kind of short-term cooporation could not bring forever clear air. The purpose of this paper is to explore whether can we built a long-term system of joint prevention and control for interstates’ air pollution and analyse the problems that should be paid attention to when establishing this system.This article contains seven chapters. The first chapter is the foreword which contains the literature review,the research methods and the innovations and imperfections of this paper. The second chapter demonstrates the necessity of establishing the legal system of interstate joint air pollution prevention and control by showing the present situation of our country and argues the practicability of this system from China’s current policy and experience of reality. The third chapter mainly analysis the theoretical basis and the guiding principle of the legal system. The forth chapter shows our present laws and regulations relevant to the interstate joint air pollution prevention and control legal system and how it practiced in reality. The fifth chapter summarizes the problems existing in building this system of our country from main body, system, mechanism three aspects. The sixth chapter displays the experiences of the United States, the European Union and Japan on the control of air pollution. The seventh chapter is proposal for the construction of the above legal system in our country.
