On The Perfection Of The Consultative Democratic Mechanism In Environmental Governance

As a basic political system,the socialist consultative democratic mechanism has laid a good institutional foundation and guarantee for the development of the consultative demo cratic mechanism.The consultation democratic mechanism is suitable for the environmental governance in which the government,enterprises and the public participate in the coordin ation of pluralistic interest subjects.Perfecting the democratic mechanism of consultation in environmental governance is conducive to protecting and managing environmental proble ms under the framework of the rule of law and democratic consultation,safeguarding envir onmental equity and justice,to ensure public participation in the environment,to create a harmonious atmosphere between environment and economic society,to promote the sust ainable development of economic and social,and to provide institutional protection for en vironmental governance.The thesis mainly adopts the normative research method,the comparative research m ethod and the empirical research method,which is divided into five parts: the introductio n part mainly introduces the background and significance of the topic,on the basis of sor ting out and summing up the relevant literature on the development of the domestic and foreign and the practice and development of the deliberative democracy,it sorts out the research trends of the deliberative democracy at home and abroad.The research method and innovation of this paper are also introduced.The first part of the text mainly defines the basis and requirements of the democratic construction of environmental governance c onsultation.Based on the related concepts,theoretical basis and legal basis of the consultat ive democratic mechanism,combined with the basic conditions of our country,this paper analyzes the necessary requirements for the construction of the consultative democratic m echanism in environmental governance.The second part combs the current situation of th e construction of the consultative democratic mechanism in environmental governance.Fro m the aspects of the case of Yuehu Lake and the subject of negotiation,the procedure o f operation and the system of protection,etc.The third part analyzes the deficiency of th e consultative democratic mechanism in environmental governance.Through brief analysis,it is found that the responsibility of the negotiating body in environmental governance is not in place,and the democratic operating procedure of negotiation is not standardized.T he environmental consultation democratic guarantee mechanism is not perfect and the leg al norms and organization of consultation democracy in environmental governance are not mature and so on.The fourth part puts forward the countermeasures to perfect the de mocratic mechanism of consultation in environmental governance.By drawing lessons from the experience of the domestic and foreign consultative democratic mechanism in the fiel d of environment,combining the theory and practice of the consultative democratic mech anism,the negotiating subject performs its duties and processes from the environmental g overnance,respectively.In order to perfect the consultative democratic mechanism in envir onmental governance,some suggestions are put forward from the aspects of safeguarding mechanism and establishing the law and organization of consultative democracy in environ mental governance.
