Study On The Legislation Improvement Of Urban Domestic Waste Classification In China

At present,the quantity of municipal solid waste(MSW)in our country is in a serious situation,even the phenomenon of "garbage encircling the city" has appeared.According to the survey,in 2018,the amount of domestic waste generated in the city is extremely large,but the comprehensive utilization rate of domestic waste is only 13.2%.The main way of municipal solid waste(MSW)disposal is simply incineration or landfill disposal,which results in a great waste of resources.At a time when China is comprehensively deepening the construction of ecological civilization system,the State Council General Office issued the Implementation Plan of domestic waste classification system in 2017,which serves as the policy basis for comprehensively guiding the classification of domestic waste in China's cities.In terms of the relevant national laws,the law on the prophylaxis and treatmen and control of the environmental pollution by solid waste is the most important basis of the trash classification law,it provides for the delegation of the Authority for the disposal of household waste to local environmental authorities,in particular,the2019 "solid waste pollution prevention and Control Law(revised draft)" for the classification of municipal solid waste for a more comprehensive system design.In addition,the Regulations on the administration of urban appearance and environmental sanitation and the measures for the administration of municipal solid waste have also made some sporadic provisions on the classification of municipal solid waste.The local legislation on the classification of urban domestic waste in China is far ahead of the national legislation.There are many relevant legislations and active legislation,and 30 cities have introduced local special legislation.In the relevant law,there are still some policy provisions.On the whole,the legislative support for the comprehensive development of urban domestic waste classification in China is seriously inadequate.From laws to administrative regulations,and then to local legislation,it has not been formed on the basis of the superior law,with the specialized law as the leader,other systems supporting the perfect legislative system.Therefore,the author focuses on China's urban domestic waste classification of the existence of the legislative issues discussed.This essay first introduces the first part,it mainly includes the background and significance of the selected topic.In addition,it also includes the domestic and international research status,research thought and means according to refuse classification.The second part of the article comments on the law of classification of municipal solid waste in China,introducing the relevant national legislation,local legislation and guiding policies,focusing on China's municipal solid waste classification of national legislation.The third part focuses on the analysis of China'smunicipal solid waste classification legislation problems.The fourth part introduces the legislation of urban domestic waste classification in developed countries and its enlightenment.The author mainly chooses the legislation of Japan,Germany and the United States,and provides reference for our country's legislation based on its experience.The fifth part is the most important part of this paper,because of the large number of problems in china's legislation at the moment,summing up the legalexperience of developed countries,the author brings forth some suggestions on the improvement of China's urban domestic waste classification legal system.
