A Study On Legal Problems In The Management Of Municipal Solid Waste About Xi'an

With the acceleration of the urbanization process in Xi'an,the urban population is increasing,and the total amount of municipal solid waste is increasing year by year,but the landfill facilities are getting to the saturation point.At this stage,the municipal solid waste treatment mode and treatment effect in Xi'an are relatively backward compared with many cities in China.The treatment of urban domestic waste in Xi'an faces many problems.For example,the pilotization of waste separation legislation is slow,the end treatment relies on film landfill,and urban domestic waste charges continue to be used at the end of the 20 th century.Under the background of the construction of “ecological civilization”,On the basis of basically achieving harmless treatment,Xi'an promotes the utilization of domestic garbage resources,reduces the source,and promotes the legal control of urban waste.It is important to improve the urban environment and ecological quality.In order to effectively promote the legal governance of municipal solid waste in Xi'an,this paper takes the theory of sustainable development and circular economy as the guide to the domestic garbage disposal and treatment and the domestic waste treatment pilot area.The legislative process and the introduction of relevant policies and implementation of urban domestic waste in Xi'an are highlighted.Based on these investigation,the author analyze the current shortage of local laws and regulations in Xi'an from the garbage classification system,the perspective of waste sorting system,reduction system and charging system.In addition,from the extended producer responsibility system,reward and punishment mechanism in the implementation of the process of looking for the current legal governance deficiencies.The author lists the domestic city of Guangzhou and Shanghai which has a good performance in theimplementation of the domestic garbage law,and the country with relatively complete construction of the waste compulsory recycling system in Germany,these experience will provide an effective reference for the legal governance of municipal solid waste in Xi'an.In the research,this paper closely follows the current situation of urban domestic garbage legal governance,domestic garbage laws and regulations,and discusses the shortcomings of the "Xi'an City Domestic Waste Classification Management Measures(Draft)",and proposes refinement suggestions.In the research,the author innovatively analyzing the current situation and shortcomings of the legal governance of urban domestic waste in Xi'an,it provides comprehensive suggestions for the development of the whole process of urban domestic waste legal governance and local laws and regulations in Xi'an.
