Research On The Legislation Of Integrated River Basin Management In Jiangxi Province

At present,various environmental problems are becoming more and more serious,especially the water resources and ecological environment of the river basin on which humans depend.The watershed is a unified ecosystem of natural resources,ecological environment and social and economic interdependence and mutual restriction.The watershed management reasonably emphasizes the coordinated management of the water resources and ecological environment of the watershed.The level of research on the rule of law in comprehensive river basin management in my country is relatively low,which is a certain distance away from the actual requirements of current river basin legislation.Since the 18 th National Congress of the Communist Party of China,the developmentof an ecological civilization has risen to the national strategic height.The comprehensive management of watersheds with "water" as the context is a new way of thinking and implementing the Party's ecological civilization construction and helping Jiangxi's green development.As a rare and unique geographical unit of the Great Lakes Basin in China,Jiangxi has conditions and urgently needs to explore the comprehensive management system of the basin.The author takes Jiangxi Province as the research object.After arranging and summarizing the current situation of water resources,water ecological environment and the urgency of comprehensive river basin management legislation in Jiangxi Province,the author comprehensively analyzes the domestic and international watershed management legislation and experience,and proposes the establishment of suitable Jiangxi Province.Legal governance system for integrated river basin management.The content is divided into the following four parts: First,the necessity and feasibility of legislation for comprehensive river basin management in Jiangxi Province.Due to the needs of social and economic development in Jiangxi Province,the requirements for the construction of a national ecological civilization pilot zone and the natural attributes of the river basin,Jiangxi Province must implement comprehensive river basin management legislation to make up for the deficiencies of the current laws and regulations and to solve the current practical difficulties faced by river basin management,And already has a certain legal basis and policy basis andthe feasibility conditions that similar legislation can refer to;second,the main issues that need to be resolved in the legislation of comprehensive river basin management in Jiangxi Province.The important issues that need to be addressed urgently in this section include: selection of legislative model for integrated river basin management,positioning of integrated river basin management institutions,and compliance with the legislative philosophy of integrated river basin management;third,domestic and international watershed management legislation and experience.Through research and analysis of the development process and system status of domestic and international watershed management legislation,summed up the experience of perfecting the laws and regulations system of integrated river basin management,coordinating the relationship between river basin management agencies and functional departments,and increasing public participation;fourth,Jiangxi Province Legislative recommendations on integrated river basin management.Starting from the legislative principles and legislative models,set up authoritative and efficient river basin comprehensive management institutions and clarify the scope of their functional authority,and establish and improve laws and regulations related to river basin comprehensive management in Jiangxi Province.Carry out comprehensive legislation in accordance with the essence of watershed management,and build a comprehensive management system and legal system suitable for the overall attributes and multi-functional unity of the river basin in Jiangxi Province.Solve the special problems in the ecological,economic and social construction of the basin of Jiangxi Province,promote the development of an ecological civilization in the basin of Jiangxi Province,and ensure the sustainable development of the ecological environment and social and economic development of Jiangxi Province.Although there are more or less limitations in integrated river basin management in foreign countries,we should fully draw on their successful experience based on their national conditions and the characteristics of the river basin in Jiangxi Province,especially focusing on the choice of legislative models(uniform legislation or decentralized legislation),The selection of comprehensive management institutions(relying on "He Chang Ban" or the formation of an independent institution)and research on encouraging the participation of the public.
