Research On The Management Measures For The Protection Of The Rights And Interests Of Migrant Workers In Construction Contractors

As a new type of labor force emerging in the historical process of China's reform and opening-up,industrialization,urbanization and modernization,migrant workers are driving China's economic and social development.However,for a long time,they are at the bottom of the construction industry,owning little power of discourse and often receiving unfair treatment.In recent years,default of migrant workers' salary have happened frequently.Although government departments have set up labor supervision departments and debt clearing offices to solve this problem,this problem has not been effectively solved due to the unique circumstance of the construction projects.Therefore,with aims to strengthen the protection of the rights and interests of migrant workers,this paper explores the effective management measures from the perspective of real estate enterprises to urge general contractors and labor subcontractors to guarantee the rights and interests of migrant workers.On the basis of extensive review of literature about peasant workers' rights and interests protection,this paper summarized the current situation of peasant workers' rights and interests protection.At the same time,the author investigated on a number of construction sites to obtain insight into the actual life and work condition of the migrant workers and the measures used by survey construction units,service enterprises,service team(labour subcontractor)cooperated-builing parties for protecting the peasant workers' rights and interests.Finally,“A” Real Estate was used as an demonstration to introduce effective management measures taken by real estate enterprises to ensure peasant workers' rights and interests.Through analysis of the complaint data in recent two years,management measures was proved to be effective and practical.The results in this study can help protect the rights and interests of migrant workers in the construction industry,promote the healthy development of the construction industry,and enlighten the construction and other industries to improve measures to protect the rights and interests of migrant workers.
