Research On The Protection Of The Rights And Interests Of Migrant Workers In The Rural Road Construction Project In Baoying County

Various of country roads have been built in China since the reform and opening up.Highway construction is a traditional labor-intensive industry,whose main projects such as construction of roadbed retaining wall,side slope supporting,bridge abutment supporting and etc.can only be completed by a large number of labor force,peasant-workers have naturally become the main force in the rural road construction team.However peasant-workers have not been involved into the personnel management system in many enterprises of building country roads,they don't have personnel management records and become the subordinate out of management system to construction enterprises,which causes many problems in labour reward,vocational training,occupational disease prevention and controlling,labour safety and social insurance of the peasant-workers working in country roads construction companies.At present,rural highway construction in Baoying county is large in volume,peasant workers are increasing rapidly,their rights and interests protection foundation is weak,and there are many restrictive factors.Therefore,peasant-workers have been generally faced with problems as discrimination in employment,low labour reward,difficult to secure the payment,safety and health rights,rest and vacation rights as well as lack of social insurance in the country-level roads construction projects of Baoying county.This article is suitable for the study on guaranteeing rights and interests of peasant-workers in the construction of county-level roads,in which,case analysis,investigation and other methods have been employed based on the institutional change theory,dual labor market theory and etc,.This article has analyzed the internal and external factors of the rights and interests protection for peasant-workers in the country road construction projects in Baoying county and suggested the main reasons to the damage of labor rights are the imperfect legal system of peasant-workers labor rights and interests,the impact of the dual household registration system of urban and rural,poor government management,lack of social responsibility in contruction enterprises and the own personal reasons of peasant-workers.The essay proposes the goal of protecting the rights and interests of peasant-workers of the country road construction projects in Baoying county as well as the detailed suggestions in building a multi-tiered legal security system,deepening the reform of the dual household registration system that divides urban and rural areas,strengthening the government management,cultivating the social responsibility of construction enterprises and improving the comprehensive quality of peasant-workers in country road construction projects.In this way,we can effectively improve the status quo of the protection of the rights and interests of migrant workers in rural highway construction projects in Baoying county,increase the sense of acquisition,happiness,belonging of such groups of migrant workers,and ensure the harmonious and orderly development of rural highway construction.
