What is the definition of justice theory? What are the features and implications of Hayek's justice theory? What are the essential differences of Marxism's justice theory and that of Hayek's? To begin with these three questions, this thesis would analyze and criticize the problems and drawbacks of Hayek's justice theory from the position, views and methods of Marxism. As a famous western neo-liberalism theorist,Hayek has a unique understanding of the justice theory.Starting from the ideas of spontaneous order,he proves the rationality and legality of capitalist private ownership, market economy and policies, and criticizes the socialist system and the Marxism. From that point,he continues to hold a negative attitude, which is based on the negative idea of justice, towards the Marxism and socialist equity concept with the tendency of equality. Therefore, his justice theory turns into a heterogeneous theory of Marxism's theory and an incorrect justice theory. This thesis analyzes Hayek's justice theory from five aspects.First, the research background of Hayek's theory is analyzed from the theoretical methods.Afterwards, the research situations of Hayek's theory abroad and at home are explained, and the various views and theories about the Hayek's theory are combed by some methods such as literature survey.Based on the process, the background and theoretical basis forming Hayek's justice theory are analyzed, and the basic features and implications are concluded. Finally, the critical analysis for the limitations and enlightenment of Hayek's justice theory are finished according to the angle of Marxism's justice theory. The analysis and criticize inspires us that people should constantly criticize various types of liberalism justice theory, and persist and develop Marxism's justice theory, which would provide a theoretical reference to the fulfillment for the harmonious and stable development of the socialism.
