A Study On The Judgment Writings In Song Dynasty

Judgment is an ancient judicial judgment document.It has experienced a long development process,and the Song Dynasty is an important period of the development and change of the ancient judgments,which has undergone a clear transformation in the writing art,so that the judgment presents a new style.This paper mainly discusses the stylistic features and significance of the judgments of the Song Dynasty by taking the judgments as the research object.From the aspects of the content and form,this paper focuses on the judicial value demands and the changes of the artistic writing of the judgments in the Song Dynasty.This paper is divided Jinto the following five parts:The introduction part briefly describes the development of the Song Dynasty judgments,explaining the significance of the ancient judgments,summarizing the current academic research on Song Dynasty judgments,as well as the research ideas and methods to be adopted in this paper.Chapter 1.An Overview of the development of the judgments in the Song Dynasty,this paper first traces the evolution of the judgments before the Song Dynasty,and briefly analyzes the position and value of the judgments of the Song Dynasty,then introduces and combs the literature retention of the judgments of the Song Dynasty.Chapter 2 Discusses the judgment spirits and the value demands of the Song Dynasty judgment.With the collected judgment of the Southem Song Dynasty "Full text"In the Northern Song Dynasty" Gong Shu Pan Ming Ji" As the example,to grasp its inherent judicial spirit from the ideological concepts of ceremony,law,benevolence and emotion,which embodies the characteristics of the Song Dynasty's judgment in advocating the rule of the etiquette,benevolence and caution in punishment,and Yan Ming's administration of the officials,etc.It provides the reference for the later writing of the judicial documents.Chapter 3 Explores the Song Dynasty judgment writing art transformation.From the three aspects of function,style and structure,this paper analyzes the concrete changes of the judgment of the Song Dynasty from drawing to the reality,from parallel to the scattered,so the practicability and application of the judgment can also be brought into the play.The concise style and the standardized and rigorous thinking"Frame" Became the new label of the judgment of the Song Dynasty.The conclusion part briefly summarizes the full text and includes the transition of the judgments in the Song Dynasty and the influence about the structure of the sentence writing and the legal standardization of the style on the later generations.
